Cristina’s rage, in limbo after her attacker’s sex change

Cristina is seething with helplessness. “My life is still hell, I have no peace, I have no tranquility, I am afraid to go out into the street, I have no protection against anyone“, lamented this woman at the gates of the courts of Seville, where she recently explained her case with astonishment: she had to defend herself against a complaint for assault filed by Candi, a trans woman who, before her change of marital status, when she was still Cándido, was sentenced to 15 months in prison for having mistreated her during more than ten years of relationship.

His case is one of the last mysteries to reach the courts after the approval of what is known as Trans lawThe standard, approved in March 2023 and which aims to eradicate situations of discrimination based on sexual orientation, has generated strong controversy over some of its points, such as the recognition of gender self-determination as the only condition for changing sex in the Civil Registry from the age of 16.

This is a situation that feminist groups have highlighted as gateway to fraud. The last case under scrutiny is the one that leaves Cristina perplexed in Seville. He doesn’t understand what happened to Candi, with whom he shares two children, but he believes in any case that it’s a joke. To her and to the system.

He makes fun of me and of Justice. He always gets what he wants. I’ve known him for many years and I know what he’s capable of,” he warned.

Cristina’s story, legally recognized in 2019 as a victim of abuse by her partner of 12 years, took a bizarre turn last July, when she went to a police station to report a new assault by the man she believed to still be Cándido.

But while she goes through the procedures to file the complaint, the officers inform Cristina: Cándido is now Candi. Her new identity was registered in the summer of 2023 and, for all intents and purposes, she is a woman. In other words, the police could not be governed by the law of Gender violence in the face of Cristina’s request. They couldn’t stop Candi.

Perplexity

Cristina’s surprise didn’t stop there. The same day he went to the police station, his ex did the same. The reason? Report Cristina for assault. Candi then claims in front of the officers that He had gone to his ex’s house to ask for explanations because his children had not eaten and that she threatened and attacked her.

At this point, Cristina no longer believes in this situation. “He He showed up at my house and attacked me“There are neighbors who saw how he hit me and grabbed me by the hair in the street,” he explained to the press earlier this month, when he went to court precisely because of Candi’s complaint.

The trial was eventually suspended because Candi failed to file a report on the injuries. For his part, The Court of Violence against Women has inhibited itself “due to a lack of objective competence” in the complaint of Cristina, who feels defenseless and says she no longer believes in justice. Her case was brought before a common court.

Waiting for forgiveness

Cristina’s lawyer, José Antonio Sires, is convinced that Candi’s entire strategy responds to “a defense mechanism to make her more psychological damage to the victim and delay the procedure as much as possible.”

Among them, the one related to the pardon that is waiting to avoid returning to prison. In August last year, a month after she registered as a woman in the civil registry, the criminal court declared that she admission to prison for violating restraining orders and threatening Cristina. He now hopes that the crime will be time-barred and he will not be able to return to prison.

“Ha exhausted all resources that the legal system allows and all have been rejected. We hope the same will happen with clemency,” Sires said.

Third case in Seville

Candi’s is the third case of this type to occur in Seville since the Trans Law came into force.

One of them is that of Antoinewho mistreated two of his partners, Patricia and Victoria, with whom he had parallel relationships, for several years. The Court of Seville confirmed in September 2023 his 40 month sentence from prison after mistreatment.

As a final shot, he made official the sex change in june 2023 and asked for clemency from the government. He claimed that he was “a new person” who had nothing to do with the old Antonio. His case also generated a feeling of helplessness among the victims.

Furthermore, he justified the commission of the crimes on the basis of a “traumabecause she felt like she was a woman trapped in a man’s body.” Both victims agreed that he was a “sexist and homophobic” person. They filed a complaint at the same time in 2019.

Ultimately, he failed to achieve his goal. This month he entered a prison in Seville after the pardon measure was rejected by the government.

Accused of poisoning

The other case is still under investigation. It happened in Two sisters with the arrest of a man who allegedly poisoned his wife. Officers suspect he added toxic substances to the food, which could also have affected the couple’s son.

The alleged perpetrator had requested to change his gender on his civil status five months earlier, as confirmed by sources in the investigation, which could be a strategy on the part of the prisoner to obtain advantages in criminal proceedings.

The couple continued to live together even though they began divorce proceedings. The woman decided to report since he felt bad after eating his partner’s food.

The Dos Hermanas prosecutor’s office is investigating whether he poisoned his wife and son with pool cleaning products. Moreover, he would not even have changed his name or appearance, as sources close to him have indicated.
