Will I have to reimburse the State for the sums received by my mother for minimum old age?

The solidarity allowance for older people (ASPA, former minimum age of old age) is intended, in general, for people of at least 65 years of age (62 in case of disability or incapacity). If it is paid by pension funds, it is not a retirement pension, but social assistance financed by the State to reduce income to a minimum.

Its amount cannot exceed, in 2024, 12,144.24 euros per year for a single person (1,012.02 euros per month), 18,853.92 euros for a couple (1,571.16 euros per month).

Since the ASPA is considered a financial advance, the sums can be recovered from the estate after the death of the beneficiary. However, the heirs will only have to return it if the net value of the deceased’s assets exceeds a certain amount.

The threshold, which was previously 39,000 euros in mainland France and 100,000 euros abroad, was raised by the pension reform. Currently it is, respectively, 105,300 euros and 150,000 euros.

About the assets of the deceased

Now it is revalued every 1Ahem January based on inflation (except abroad, where it is fixed until the end of 2029).

The heirs will not be obliged to reimburse ASPA from their own assets. The amount to be returned is deducted from the amounts above the aforementioned thresholds, from the net assets of the inheritance that corresponds to the heirs: the value of the deceased’s assets after deducting personal debts, outstanding charges and funeral expenses ( up to 1,500 euros).

For each year of receiving ASPA, there is a recoverable maximum: 8,207.37 euros for a single person, 10,980.22 euros for a couple (2024 amounts).
