I made a mistake reporting a claim to my insurer, will I still receive compensation?
The insurance contract is a contract of good faith: the insurer refers to the statements of the subscriber, without systematically verifying their veracity.
The misrepresentation may or may not be intentional. In the involuntary case, for example due to carelessness or a fortuitous error, the insurer may apply a reduction in the amount of compensation initially provided for in the contract or update the premium upwards. You may also terminate the contract, if you so decide.
However, if the false statement is intentional (for example, a false theft or the issuance of false invoices to inflate the amount of compensation), the insured is exposed to severe penalties.
Compensation refund
Thus, the insurer may, in particular, request reimbursement of compensation previously paid or retain contributions paid in advance as compensation.
It may also declare the insurance contract void and deprive the insured of his guarantee rights. Criminal sanctions may also be applied depending on the seriousness of the facts, up to five years in prison and a fine of 375,000 euros.
Please note that in the event of termination due to misrepresentation, it will be difficult to find a new insurer and you will have to pay a much higher premium.
