Former Minister Campo abstains from voting in the TC during the deliberation on the amnesty law

The magistrate of the Constitutional Court (TC) and former Minister of Justice Juan Carlos Campo presented on Tuesday a document in which he communicates his abstention on the question of unconstitutionality raised by the Supreme Court in relation to article 1 of the amnesty law.

This was announced by the Court of Guarantees, explaining that Campo raised his abstention with the president of the TC, Cándido Conde-Pumpido, based on the provisions of articles 22 and 80 of the Organic Law of the Constitutional Court and articles 217 and 219.10. a of the Organic Law of the Judicial Power.

This abstention will be deliberated during the plenary session of the Constitutional Court scheduled for next week, along with the other questions on the agenda.

The Supreme Court has decided to appeal to the Constitutional Court for the first time regarding the amnesty law for the “trial” for the crime of public disorder. The judges did so because they are “absolutely convinced” that the norm violates “at least” the right to equality and the principle of legal certainty.
