Former Minister Juan Carlos Campo will abstain from the TC’s deliberation on the amnesty law

The constitutional magistrate Juan Carlos Campo, former Minister of Justice, This Tuesday morning, he presented a letter to the president of the court, Candido Count Pumpidoin which he communicates that he will refrain from deliberating on the amnesty law.

Just two months ago, the Supreme Court raised a question of unconstitutionality regarding this controversial standard.

Now, Campo announces that he will not participate in its deliberation, based on what the Organic Law of the Constitutional Court and the Organic law of the judiciary.

More specifically, Article 219.10 of the latter includes, in the list of reasons for abstention, the “thave a direct or indirect interest in the trial or cause.” And this is one of the precepts that Campo cites in his letter sent to Conde-Pumpido.

Your abstention will be deliberated in the Plenary of the Guarantee Court scheduled for next week, as well as the other items on the agenda.

At the end of July, the Supreme Court raised a question of unconstitutionality so that the Court of Guarantees could rule on the legal validity of the amnesty law.

Among other extremes, the Criminal Chamber of the Supreme Court considered that the controversial norm It violates equality before the law enshrined in the Magna Carta, “as well as the principles of legal certainty and the prohibition of arbitrariness proclaimed by the Spanish Constitution; and which, subsidiarily, could violate the principle of jurisdictional exclusivity.”
