After the Superior Court of Xustiza de Galicia declared null and void the first sentence that acquitted Nerea’s friend Añel from Ourense, The Provincial Court of Orense sentenced him to 10 years in prison considering him responsible for the crime of homicide by omission.
The lifeless body of Nerea Añel was found in a riverbed in Barbadás, in the province of Ourense, eight months after his disappearance -in January 2020-.
The TSXG rendered this judgment on Monday, after declaring null, last June, the first sentence pronounced by the Provincial Court. In this sense, It was “a different conclusion from that reached by the jurors”.who had addressed the accusatory thesis”.
For this reason, he ordered that the proceedings be brought back to the moment before the resolution was pronounced, with the aim of imposing another sentence consistent with the guilty verdict handed down by the jury. And the people’s court understood that the victim’s death was due to the person concerned’s failure to provide assistance.
With regard to the above, the judge who presided over the jury court indicated that the accused, as was considered proven in the verdict record, “was present at the time the head injury occurred of the victim and did not provide him with the assistance necessary to prevent his death.
In this way it was proven that the death of the woman, aged 26, “was caused by lack of assistance that his partner had to lend him after his fall at an undetermined time”, as collected European press.
The jury thus accepts the thesis supported by the forensic doctors according to which the injuries suffered by the victim fThey are the result of a fall due to precipitation, which they consider to be mostly accidental. The award is not final, as an appeal may be filed against it to the TSXG.
