Sven Libikh, now known as Marla – Schnenia Libich, was convicted of distant activity, including inciting to hatred, and is going to begin a sentence of 1.5 years in prison.
Nevertheless, it is assumed that the gender registration has deliberately changed in order to influence the conditions of detention in prison.
According to current plans, he will initially take place in prison for women.
The reason for this is the self -disclosure of gender identity in accordance with the new provisions of the law on self -determination, which entered into force in November last year. The changed law allows you to adapt gender registration using a personal statement.
Since the plans of the coalition government by law were known, fears have been repeatedly expressed about possible violence. During the election campaign, the Center -Kongress raised the problem. Andrea Lindoltz, then Deputy Chairman of the CDU/CSU parliamentary group, said in April last year that the coalition “lost” under this law.
The agreement signed by SPD and CDU/CSU last May simply stated that the law on self -determination would be considered “no later than July 31, 2026.”
The Ministry of Family Affairs is responsible for the law that was under the auspices and was jointly drawn up by the Minister of the Coalition Judge Marko Buman (FDP) and the then Minister of Family of Green Lisa Paus.
Therefore, during the negotiations of the coalition between CDU/CSU and SPD, this did not concern the working group of the Law, but the negotiators of the “family” department. However, according to the Zitung Bild, it was impossible to reach an agreement on how to cope with the law. As a result, this issue was again aimed at the party leadership. The result was simply an uncertain formulation in the coalition agreement.
“Clear criteria”
According to MDR, Benedict Burgen, a representative of the office of the Halle prosecutor, the decision to place on the present is based on two clear criteria: an officially registered floor, in the case of Marla – Slenia Libich and a registered place of residence.
Since this is Saxony, a plan is introduced in force, which provides for the detention of female prisoners in Kemncha prisons.
Nevertheless, the Ministry of Justice of Saxony was informed by Mitteldesh Zeitung that in some cases additional psychological or medical reports can be used. These include, for example, if there is a suspicion that it was possible to deliberately change the registration of the floor in order to influence the conditions of imprisonment in prison.
In July 2023, Libikh, then known as Sven Libikh, was sentenced to one and a half in prison without suspending the regional court of Hale.
The verdict included incitement to hatred, insult and slander. The appeals of both Libikha and the State Prosecutor did not fail in the regional court of Hale.
