He loved the boy who rented his house: “They demanded that I take money from my father”

Hasan Rustamov, born in 1977 in the city of Sumgayit, injured his daughter’s brother-in-law, Panah Abbasova (name and surname provided – ed.) during a personal dispute.

According to Telegraf.com, the incident took place on December 21 last year near the railway crossing located in Tuqzavod, in the city of Sumgayit.

Hasan’s daughter Sevil’s brother-in-law made a comment to Panah due to disputes in Sevil’s family. Panah punched him.

Annoyed by this, Hasan punched Panah’s stomach, groin and back.

The investigative body announced a charge against Hasan under article 126.1 of the Criminal Code (deliberately causing serious harm to health).

“My partner made me lose my mind”

Hasan, who testified as a defendant in the criminal case, pleaded guilty to the charges brought against him. He noted that he had previously been found guilty under Article 315 of the Penal Code (resistance or use of force against a representative of the authorities) and sentenced to 3 years and 6 months of restriction of freedom. By decision of the Sumgayit Municipal Court of 2022, the sentence was reduced by 1 year:

“I finished serving my sentence in 2023. I am married, I have two children, I am self-employed. In 2020, my wife told me that our neighbor Sadiq wants to start a family with my daughter Sevil. At first, I expressed my discontent with this issue .Because your family’s lifestyle is suitable for our family. However, my wife Samaya convinced me to accept my daughter’s marriage with Sadiq.

According to the agreement between us, we would build a private house for my daughter’s family in the courtyard where we live. “I myself would support them financially on a daily basis.”

“I asked my daughter why they hit her”

According to the accused, his daughter Sevil did not have an official marriage with Sadiq:

“I repeatedly expressed my displeasure to Sadiq’s mother, Kamala. However, Kamala always told me that they would get married soon.

My daughter was oppressed in Sadiq’s family from the first days of her family life. At first only Sadiq hit my daughter, but then his brother Panah started hitting her too. I spoke to them several times, I asked them what they wanted from my daughter, they never admitted what they did. I even once brought my daughter to my house to free myself from the oppression she suffered.

After staying at my house for several months, Kamala reconciled with us. Admitting their mistakes, they promised they would never hurt my daughter again. I, on the other hand, gave my daughter additional equipment as dowry and told her that it would help her improve her livelihood.

Although I provided financial help to my daughter’s family, there was no daily meal in their house. One of the days my daughter was beaten, I asked her why she was being beaten. “She said her husband wanted to eat after returning from work, but since there was no food at home, he couldn’t cook, so they beat him.”

“I didn’t ask for an account”

According to Hasan, he went to Lachin district for work purposes.

“About 4 or 5 days before the incident, my wife Samaya told me that my daughter was beaten by her brother-in-law Panah and returned home. Since I was in Lachin, I never called them to ask for an account. My intention was to meet and talk face to face when he returned to the city of Sumgayit.”

Hasan said that when he returned home, he spoke to his daughter:

“When I asked him why he was being beaten, he said that he had been beaten first by his mother-in-law Kamala and then by his brother-in-law Panah. When I asked him why, it turned out that he was being forced to do it. Ask me for money.”

“I used inappropriate expressions towards family members”

The accused stated that on the day of the incident he saw Panah near the train tracks located in Tuqzavod, Sumgayit City:

“I called her. I had consumed a small amount of alcohol at the time. I greeted Panah and asked her why they were beating my daughter. She said that my daughter was not beaten, that her brother was angry with my daughter because she left . the house alone. I asked Panah to leave the neighborhood where we live. He insisted that they would not leave his house, that the cause of the fight is my daughter.

I was angry because Panah insulted my daughter. I used inappropriate expressions towards him and his family members. Panah hit me several times in the face. I realized I couldn’t match him because he was younger than me, athletic and big. Pulling out the knife I had tucked into the waistband of my pants, I stabbed Panah twice in the abdomen. My goal was to scare Panah and get them to leave the settlement.

Panah continued to hit me several times on the head and face despite the knife wound. I could no longer maintain my balance due to the impact of the blows, I crouched down. At this moment, Panah turned around and wanted to leave. I hit him in the back with a knife. He started running towards the direction where they lived. I threw the knife into a nearby canal and walked away.

“The next morning, I voluntarily came to the Sumgayit City Police Department and turned myself in.”

“There was no discontent between them”

According to Panah, who testified as a victim in the case, he lives with his relatives in the dormitory of the Vocational Lyceum No. 147 located in the city of Sumgait:

“Although my brother Sadiq married Sevil, who lives in the same city as us, in July 2020, they did not have an official marriage. There was no dissatisfaction between them. However, sometimes Sevil’s father Hasan came to the address where we were. He was drunk and wanted to take his daughter. That’s why there were disputes in the family.

“He said he was going to his father’s house.”

According to the victim’s statement, on December 7 of that year, when he was at work with his brother Sadiq, Sevil left the house alone and went to his father’s house without notifying his mother and other relatives:

“My mother became angry at Sevil’s arbitrary action and an argument broke out between them.

When my brother and I got home that night, my mother told us what had happened and said that Sevil had gone to his father’s house for once.

Panah noted that a few days later Hasan called him and told him that he was in Lachin district and asked him to send him Sevil’s remaining belongings:

“I rented a car and brought all of Sevil’s remaining belongings to them. Meanwhile, I maintained normal communication with Sevil and his family members. There was no aggressive behavior.”

“He insulted me out loud non-stop”

Panah spoke about the day of the argument between Hasan and him:

“He used obscene expressions against me and my relatives and insulted my mother with bad words in the street. In response, I punched him in the face. He was drunk and lost his balance due to the impact of the blow and started cursing louder. “I was angry because Hasan insulted me loudly. I hit him several times in the face and head. At that moment he took out the knife that he had put in his pants and hit me twice in the stomach.”

“We did not torture your daughter”

According to Sadiq, who testified as a witness in the case, Sevil’s parents were creating rumors in the family:

“Her father, Hasan, drinks alcohol regularly and, drunk, came to the address where we live to take his daughter home. I even saw several times that Sevil was not at home when he returned from work. When I asked my mother, I was “He said that Sevil had gone to his father’s house, however, neither I nor my relatives physically saw Sevil and we did not torture him.”

According to Sevil, who spoke as a witness in the case, he studied until the ninth grade at the vocational secondary school located in the Ceyranbatan Baglar massif, in the city of Sumgayit:

“Sadiq studied in the same high school as me, but a grade lower. During school, Sadiq confessed his love to me. I informed my father. My father was angry with Sadiq. After that, I had no contact with Sadiq.

At the beginning of 2020, my father built another single-family house near the house where we live. I wanted to pour concrete on the top floor of that house. While looking for workers who could do the job, my brother told my father that he had friends and that he would call those kids for help.

The person whose name I later learned was Panah came to our house with my brother. My brother introduced him as a friend. My father told Panah that he was alone and couldn’t do the job.

Panah said his brother was at the mobilization office and would come to him for help once he finished his work. About half an hour later, I saw Sadiq coming. I understood that Sadiq and Panah are brothers. The two brothers did their work together and then my father paid for their work.

A few days later, Kamala, Sadiq’s mother, came to see my father and asked for a house to rent. My father said that none of the houses were empty.

That night, when my father said that Kamala had come to him, my mother said that she knew Kamala and asked him to help her move to our relatives’ house. At my mother’s request, my father helped Kamala and her children move into a relative’s house.

After a while, Kamala allowed them to move there because she said the house had not been repaired and they could not live there, and also because the house near my father’s house was empty at the time. For a time, Kamalgil lived in a house that belonged to us on rent.”

“They asked me to take money from my father”

Sevil noted that in mid-2020, Kamala approached her mother and told her that she wanted to buy it for her son Sadiq:

“My father was upset at first, but he agreed at my mother’s insistence. Although I started a family with Sadiq, we were not officially married. Whenever I asked Sadiq and Kamala why they didn’t get married, they always tricked me with an excuse

From the day we got married, my father provided financial support to our family. When my father didn’t buy us food, we had almost nothing to eat at home. Sadiq used to hit me when the food was not cooked at home. He and his mother Kamala demanded that I accept money from my father. Sometimes I couldn’t get money from my father because I was embarrassed. At that moment they were beating me.

Recently, my brother-in-law Panah started beating me. Although I went to my father’s house several times, they apologized and sent me back. The last time I went to my father’s house because they beat me. “My father was in Lachin district, I called him and told him that Panah had beaten me.”

This criminal case was heard in the Sumgayit Serious Crimes Court. According to the court’s verdict, Article 70 (conditional sentence) of the Penal Code was applied to Hasan. He received a suspended sentence of 3 years and 6 months with a probationary period of 1 year.
