Nahid, born in 1998 in Gadabay district, had sexual relations with Gulshan (names provided conditionally – ed.), with whom she had a minor romantic relationship.
According to Demokrat.az, the incident took place on August 30, 2023, around 11:00 p.m. in the village of Gadabay district.
At her aunt Amina’s house, located in the village of Nahid, she had unnatural sexual relations with Gülshan, who was clearly under sixteen years old, with an age difference of more than two years.
The perpetrator of the incident, Nahid, was charged under article 152.1 of the Penal Code (having sexual relations with a person who has reached the age of fourteen but less than sixteen or performing other acts of a sexual nature).
Nahid, who testified as a defendant in the criminal case, pleaded guilty to the charges that were announced to him. In his statement he stated that he lives in the village of Gadabay district with his relatives: “I wash cars in the car wash located in the village where I live and support my family. I voluntarily participated in the Second Karabakh War, received three medals, and was wounded once but after recovering I returned to the fight and fought until the day the lands were liberated.”
According to Nahid’s statement, he met Gulshan in June 2023 in the village of Gadabay district: “Gulshan came to visit my village mate Mahiragil that year, and from that time we saw each other, a love relationship arose between us. My opinion was serious. On August 29, 2023, when I spoke to Gulshan on phone, I offered to run away with me to get married and Gulshan accepted my proposal. On August 30, I drove my car. VAZ-2111 to Ganja city and took Gulshan to my aunt’s house in Gadabay district. Gulshan told me that she was not 16 years old. I had sexual relations with her unnaturally. I did not have any physical or mental influence on her. her when I kidnapped her. We lived together as husband and wife.”
According to Gulshan, who testified as a victim in the case, he lives with his parents and other relatives in the city of Ganja: “I went to visit the house of my aunt Mahira, who lives in a village in Gadabay district. While I was there, I met accidentally to Nahid, who lives in that village, and we gave each other our phone numbers. We kept in touch regularly. Nahid said he wanted to marry me and offered to run away on August 29, around 8 pm. I spoke to Nahid on phone and during the conversation, Nahid offered to go to Gadabay district to get married. I accepted his proposal.
The victim stated that on August 30, around 9:00 p.m., he met Nahid near the house where he lives and with Nahid’s car they arrived at the village of Gadabay district, to the house where Nahid’s aunt lives. : “That night, Around 23:00, accepting Nahid’s proposal, on the basis of voluntary consent, the victim had sexual relations. I am not complaining about Nahid, we live together as a family now.
This criminal case was heard in the Gadabey District Court. According to the court’s verdict, Article 70 (conditional sentence) of the Penal Code was applied to Nahid. He was given a 1-year suspended sentence with 8 months of probation.
