Judge dismisses Nacho Cano’s complaint against his intern for extortion

The judge investigating Nacho Cano for crimes of promoting irregular immigration and alleged exploitation of workers has not admitted the producer’s complaint against the intern who first reported him. Nacho Cano’s complaint included messages between the producer and the intern, in which the woman asked Cano for 6,000 euros for “moral damages” and a letter of recommendation not to report her, which the complainant eventually did.

Now, in an order notified to the parties this Wednesday, the judge of Court number 19 of Madrid rejects Nacho Cano’s complaint and considers the messages that the intern provided to the producer as “inadmissible and unrelated to the clarification of the crimes for which he is being investigated.

“The purpose of this procedure is the investigation of crimes against the rights of foreign citizens and against the rights of workers, so in addition to the statement of the complainant and the injured Ms. Lesly, we have other means of evidence, being unimportant l“The conversations are provided to clarify whether the persons investigated participated in the alleged events,” the judge said in her order.

The complaint for “extortion”

Last week, Nacho Cano denounced Lesly Guadalupe Ochoa Flores, the intern of the Malinche show, who sued the artist for violating workers’ rights, for “conditional threats and revealing secrets.”

The musician presented as evidence of the alleged blackmail the messages sent via WhatsApp from the intern’s phone to the head of the musical’s production in which she demanded a payment of 6,000 euros, a letter of recommendation and a stay in a hotel to avoid “proceeding legally.”

In the complaint, Cano’s legal representative believes that Guadalupe Ochoa Flores “tried to blackmail” Nacho Cano “into complying with her demands, otherwise he and the rest of his 17 Mexican interns would be seriously harmed.”

The messages were allegedly sent on December 22, 2023, before Lesly Guadalupe Ochoa filed the complaint. “By reaching this agreement, I am not acting legally and I do not remember that they exist,” the letters state. “I promise to take all my things out of the hostel as soon as the payment is settled and that’s it, they will not hear from me again. I always sign what they ask me to, as long as it does not harm my career or my person,” he said.

According to Nacho Cano’s lawyers, after refusing the alleged blackmail, he launched “a campaign of attack, discredit and harassment against the musician and the management of the musical Malinche.” The producer also accused the intern of the crime of revealing secrets since, according to the complaint, when she was hired, she signed a series of documents assigning rights, authorizing image rights and an indefinite confidentiality agreement.

The complaint also stated that the intern was responsible for the situation: “She failed to adapt to the program and caused numerous clashes with her colleagues, making coexistence unbearable” and this, the complaint insists, is the reason why she was expelled from the project.
