The judge of the National Court Ishmael Moreno rejected the appeal presented by the former Minister of Transport Jose Luis Abalos in which he requested to appear as an injured party in what is called Koldo affairin which irregular allocations of masks during the pandemic, while he was head of the ministry, are being investigated.
The owner of the Central Court of Instruction number 2 of the National Court rejected the appeal filed by Ábalos, who claims that the publication of information related to the processing of the case causes him “irreparable harm”.
Moreno specifies that “You cannot be given the status of offended or aggrieved in this procedure.“, since the crimes under investigation (criminal organization, money laundering, corruption, influence peddling and delinquency against the Public Treasury) make “such a condition difficult or rather impossible”.
The judge emphasizes that “possible revelations about the procedural actions are the subject of an investigation by the Madrid investigating court.”
Regarding the discrepancies with the content presented in the audit report carried out by the Ministry of Transport, the judge indicates that Ábalos “must debate or question them in other forums but not within the framework of the present procedure “.
