Judge takes Alvise Perez to Supreme Court for threatening her on social media

The president of the Court of Instruction number 18 of Seville has sent to the Prosecutor’s Office of the Supreme Court a battery of messages sent by Luis Pérez Fernández – known as Alvise – on his Telegram channel so that he can study them in case he considers that there are signs of threats and repression of the judicial function sufficient to file a complaint before the Second Chamber, where the leader of Se Acabó la Fiesta (SAF) is a Member of the European Parliament.

This is the same judge who is hearing the complaint filed by FACUA Secretary General Rubén Sánchez against SAF electoral list member Vito Quiles for defamation. He is expected to be investigated on November 25, after appearing in the case in June.

The events date back to that date. The magistrate, trying unsuccessfully to have Quiles appear before the court regarding the complaint, ordered the police to find out where he was and to inform him of the existence of the case. In the preamble to this resolution, it was erroneously stated, as the court would later clarify, that he was also to be arrested and placed at the disposal of the magistrate.

As a result, Alvise Pérez published a message to the tens of thousands of people who make up his group on the social network Telegram giving the judge “24 hours” to rectify this order, under penalty of publishing, he said, “things about the definition of the term ‘corruption’.” The idea was then to imply that he had called the magistrate by telephone and to take credit for this rectification, which actually happened because there really was a mistake in the resolution.

At that time, the Secretary General of FACUA informed the judge of the messages so that she would be aware of them. After studying them, he decided to submit them to the Prosecutor’s Office of the Supreme Court, “given that the two Telegram messages provided by the complainant contain expressions referring to the complainant as a judge of first instance of this Court that may constitute threats and repression of the jurisdictional function.

“It is agreed that the testimonies will be made public by the individuals who will be mentioned below and that they will be sent to the Office of the Prosecutor of the Supreme Court so that if they are considered criminal submit the appropriate complaint to the Criminal Division of the Supreme Court“, says the resolution, put forward by eldiario.es and consulted by ABC. If it is considered that the messages reveal signs of a crime, the case would end up in the hands of the Chamber presided over by Judge Manuel Marchena.
