Judicial error keeps man convicted of sexually abusing girl in Cádiz on the streets

Man found guilty of sexually abusing girl in Cádiz avoided going to prison although he broke the restraining order because the Provincial Court of Cádiz did not properly inform him of the obligation not to approach his victim within 400 meters.

The lawyer for the girl’s family, Juan Manuel Espinosa, regretted this “bureaucratic failure” this allowed this man who showed up at the gates of his victim’s school to remain on the street only three months after being sentenced to two years in prison and seven years in prison.

The sentence, as the attorney explained, was appropriate because the little girl’s family did not want her to go through the trauma of a trial and preferred to avoid the delays that a hearing and subsequent appeals would have caused. .

This sentence of compliance was read on June 26 in the third section of the Provincial Court of Cádiz, and in it the man admitted to abusing girl at homewhere she had gone because she was a friend of her son of the same age, to limit a prison sentence of two years, in which she would not have to enter as long as she respected the measures provided, such as not not approach the victim within 400 meters for seven years.

In September, just three months after this reading, was seen by the girl’s mother at the school gatesreported him and the man was arrested. During the quick trial that followed, the prosecution brought by the victim’s family and the prosecutor’s office requested immediate imprisonment, and that’s when the man claimed he had not received the ‘court order with the restraining order.

The investigating court asked the provincial court the official signed notification, but the court confirmed that he was not required to sign after the sentence was read aloud, nor was it subsequently sent to him in writing, so the court did not could not follow through on the request for imprisonment requested by the charges.

According to the girl’s family lawyer, Man Violated Restraining Order Again and there is no evidence that he has yet received the request prohibiting him from approaching the victim, which is why he is demanding a solution to prevent him from raping her again with complete impunity.
