Justice authorizes participation of “yellow vest” union

Almost six years after their first mobilization in the roundabouts, the “yellow vests” continue to serve as an emblem, sowing – in the process – a bit of enthusiasm in social democracy. The Paris judicial court ruled that he had the right to participate in the elections for very small enterprises (VSE), which are to be held, in principle, from November 25 to December 9. On March 13, the services of the Ministry of Labor prepared the list of organizations authorized to participate in voting in the VSE, voting operations that allow measuring the audience of unions in companies with fewer than eleven people. Among the selected candidates is that of the Yellow Vest Union of Unions, created at the initiative of, among others, former CFDT activists, including Alexandre Torgomian and Stéphanie Poursac.

The approach of this new participant was questioned by the actors who were already present. The CFDT, CFE-CGC, CFTC, CGT, FO and UNSA appealed to the Paris court to annul the ministerial decision of March 13, arguing that these “yellow vest” representatives cannot claim to be unions. . , failing to comply with several conditions required by law (financial transparency, independence, respect for republican values, etc.). Their arguments were on target as the judges concluded, at the end of May, that the Union of Yellow Vest Unions was “Inadmissible to run as a candidate[e] ». But the Court of Cassation, in turn, annulled, a few weeks later, the ruling of the Paris court and ordered that the case be re-examined. Hence a new hearing, which resulted in Monday’s decision, this time in favor of the “yellow vests.”

An uncertainty
