The Provincial Court of Madrid has definitively ratified the filing of the complaint filed by Minister Óscar Puente against Lucas Burgueño, the man who reprimanded him on board an AVE train in September last year. The judges understand that the intention of the accused was to “annoy him, provoke him” and “generate a certain amount of media coverage” but “not to restrict his freedom” and all without resorting to violence.
Burgueño was involved in this incident with Puente aboard a train that was taking the then-MP to Madrid for Alberto Núñez Feijóo’s failed second investiture vote. The man stood in front of Puente and, during the recording, asked him several questions about Carles Puigdemont before the socialist deputy demanded the presence of the police: “This man is trying to prevent my passage.”
The complaint fell into the hands of Court 30 of Madrid, which closed the proceedings in early 2024 because “there was no indication of criminality” or coercion. The Provincial Court recognizes that this first file from the judge was very poor in details and arguments, limiting itself to repeating the opinion of the prosecution, which for the magistrates “is not very precise or advisable, from a point of view legal and constitutional. see.” “.
On the merits, the Court considers that Burgueño’s attitude does not constitute any crime: “There is no violent attitude or intimidation”, specifies the order. “Mr. Óscar Puente was able to get into the wagon and travel with it to Madrid, so there was no limitation on his right to freedom,” affirms the court, which even accuses Puente of having confronted the accused. Puente left, they added, “without major consequences.”
In the days that followed, the protagonist of the incident was arrested for other acts, including for forcing a woman and for trespassing, and it was also revealed that he was awaiting trial for allegedly coercing his ex -companion. That day on the train, the judges affirmed that “he did not intend not to attend the parliamentary session nor to be able to travel on the train, but only that he wanted to formulate a public recrimination against him for what he considered dishonorable. , making it in a rude and unpleasant way.
