The Tarragona court denied amnesty to an IT worker who faces a request for an 18-year prison sentence, accused of attacking the websites of several Spanish companies and organizations opposed to the process in the months that followed the referendum of October 1, 2017.

Amnesty has taken a back seat, but courts continue to decide whether or not to apply it to citizens who are not part of the political leadership but who have been involved in criminal cases related to the sovereignty process.

Although the law, in force since last June, gave judges two months to apply it, the Tarragona court has not resolved the refusal of amnesty for this accused, one of those who run the greatest risk to enter prison, only on October 23.

In the order advanced by El Nacional and to which elDiario.es had access, the second section of the Court of Tarragona, in accordance with the criteria of the Prosecutor’s Office, rejects the request for amnesty raised by the defense of the accused person, Joël M. ., accused of several computer attacks carried out between December 2017 and February 2018.

The court, in a paragraph, considers that even if the events fall within the “time limit” provided for by the amnesty law, “these actions do not fall within the objective scope” of the law. The order can be appealed before the Superior Court of Justice of Catalonia (TSJC).

The other ongoing case in Spain against a hacker accused of actions in favor of the referendum ended up being archived.

He computer hacker He is awaiting trial in the Tarragona court, in a case in which the prosecution is asking him for 18 years in prison and a fine of 10,000 euros for attacking several websites of public and private companies and public bodies opposed to ” proceedings”, as well as the illegal dissemination of information obtained in the databases of said pages.

The prosecution opposed the amnesty of Joël M., considering that the law does not cover the offenses of unauthorized access, discovery and disclosure of secrets and computer damage for which he is accused. The Public Prosecutor’s Office claims that the accused attacked several company websites, including the Spanish Railways Foundation, and claimed responsibility for his act by adding the labels “Anonymous”, “OpCatalunya” and “FreeCatalanPoliticalPrisoners “.
