Labor gives companies six months to include measures to protect the LGBTI community in their agreements

This set of measures, which includes protocols against harassment and violence, aims to guarantee “real and effective” equality for LGTBI people. “What we are doing with this standard is developing the Trans law” he explained Yolanda Diaz during the press conference of the Council of Ministers.

Companies with a collective agreement must establish, within three months of the entry into force of the royal decree, a trading commission. From there, the negotiation will last a maximum of three more months, after which at least the measures included in the royal decree itself will be applied.

For their part, companies that do not have a collective agreement will have six months to negotiate the new measures, after which the minimums established by the standard will be automatically applied.

The planned measures should include clauses guaranteeing equal treatment and non-discrimination, covering sexual orientation, gender identity and expression, as well as sex characteristics. This will also encourage training of workers, particularly in selection processes and professional promotion, to guarantee a career on an equal footing.

He action protocol against harassment and violence It will protect not only employees, but also candidates, suppliers, customers and visitors. Additionally, this will ensure confidentiality, protection of the victim from retaliation and prompt investigation of complaints.

The rule also requires companies to allow trans employees to benefit authorizations without discrimination to attend medical consultations or carry out legal procedures.

Reduction of working hours

On the other hand, the second vice-president argued that the rule that will regulate the reduction of working hours will be approved as bill currently being processed urgently. Also for the Minister of Labor, this will make it possible to respect the government agreement between the PSOE and Sumar which establishes the reduction of the weekly working day to 38.5 hours this year and to 37.5 hours in 2025.

“In the parliamentary process we are going to accelerate as much as possible,” said Díaz, who insisted that “beyond the deadlines” we must examine the activities for which there could be difficulties in the application of this measurement.
