Man KILLED his wife in bed – DETAILS of crime in Khizi

Abulfat Aliyev, born in 1963, killed his wife Bahar Mustafayeva, born in 1971, following a personal dispute in the Khizi district.

According to Demokrat.az, Abulfat was discharged from the Republican Psychiatric Hospital, where he received treatment in 2022. That evening he had an argument with his wife Bahar over personal relationship reasons.

Abulfat, who was angry at this quarrel, did not sleep that night and, to take revenge on his wife, he took a hammer from the box where household utensils were kept at the entrance of the house and went to the bedroom. Abulfat saw Bahar lying on the bed with his face towards the wall and killed him by hitting him several times on the back of the head with a hammer.

Abulfat, the perpetrator of the incident, was charged under Article 126.3 of the Criminal Code (deliberately causing serious harm to health, when carelessness causes the death of the victim).

Abulfat, who testified as an accused in the criminal case, said that he married Bahar about 20 to 25 years ago and has two children. His daughter Ulviyya got married a few years ago and lives in Mashtaga. His son is called Asiman, he is about 20 years old, he is single. Abulfat said that for almost 30 years he has been receiving treatment for nervous diseases at the psychiatric and nervous hospital located in Mashtaga, he was treated in the hospital for 30 to 40 days and stayed at home for two to three months.

The defendant stated that on the evening of May 31, 2022, together with his brother Kamaleddin, he left the Mashtaga Psychiatric Hospital and arrived at the house in Yeni Yashma Village, Khizı District: “On that day, my mother Zahra and my wife Bahar went home. There was no one else at home after dinner. After leaving the hospital on May 31, Bahar worked in a place she did not know. When I got off the bus, I said, “Why did you come to see me?” “I came because my heart wanted to,” my wife began to frown. Then we returned home together. Although I treated her sweetly, she behaved in the opposite way. I could not sleep at night because of this attitude towards me.

Abulfat added that he got up in the morning when the weather was clear, took the tool out of the iron box and gave my wife a hard blow on the back. No one heard me, I didn’t even notice. At that moment, I threw the tool squarely in the yard. Shortly after the incident, I wanted to go to Züleykhagil’s house. When I entered the house, he was sitting in the hallway. I saw Bahar bleeding from the head. I called my mother and said, “Come and see, someone has hit Bahar.” My mother was able to say, “Don’t lie, you did it, there was no one else at home, you shot Bahar.” After that, I went to see Haqikat Khalagi, an old woman from the village. I didn’t tell her anything about what I did. After sitting there for 10 to 15 minutes and drinking a cup of tea, I went home. My brother Kamaleddin came and put me in the car. I was admitted to Mashtaga hospital, where I received treatment. I’ve been sleeping there ever since.”

The defendant added that his wife was not present when he hit Bahar: “The reason I hit my wife was because she did not treat me well. The iron tool I used to hit my wife was a tool called a hammer, which has a hammer on one side and a nail puller on the other. When I hit my wife, there was no one in the house we lived in except my mother, no one saw me hitting her head.”

According to a relative questioned as the legal heir of Bahar, the victim in the case, her sister Bahar married Abulfat in 1996: “Abulfat kidnapped my sister that year to start a family. They got married and lived together, a son named Asiman was born in 1992. Before getting married, Bahar worked in a bakery in Sumgait for the past 10 years. I did not know about the relationship between them in the past years.”

The legal heir added that he was last at home on the eve of May 15-20: “Bahar visited Sumgait. When I took my sister and her son to their home in the Yashma settlement, I found out that her husband Abulfat was in a psychiatric hospital in Mashtag. Bahar was in Sumgait almost every day after work. I saw him coming to have a cup of tea. The day before the incident, Bahar came to us as usual. At 6:30 p.m. she headed to the Yeni Yashma settlement.

According to the legal heir’s statement, on the day of the murder, at around 9 a.m., they were told to go to Sumgayit Trauma Hospital because Bahar was sick: “I arrived at Sumgayit Trauma Hospital at 10 a.m. At 12:30, Bahari was taken by ambulance to that hospital with his head bandaged and his hands swollen. According to the doctor, I had head injuries every day. In intensive care, Bahar died at around 1 p.m. We took her body to Shamakhi that day and buried it in the cemetery in Hamya village on the 6th of the month.”

This criminal case was heard in Sumqayit Serious Crimes Court. According to the court’s verdict, Abulfat Aliyev, who committed the criminal act under Article 126.3 of the Criminal Code in an unreasonable situation, was exempted from criminal liability and punishment under Article 21.1 of the Criminal Code. Pursuant to Articles 93.1-1.1 and 95.0.4 of the Criminal Code, the accused was subjected to compulsory medical measures. He was compulsorily treated in a specialized psychiatric hospital under intensive care.

The implementation of the part of this decision related to compulsory treatment in a specialized psychiatric hospital was entrusted to the Republican Psychiatric Hospital of the Ministry of Health. The decision to pre-trial detention the accused was cancelled. The security measure of placement in a special medical institution chosen for him remained unchanged until this decision comes into force.
