Cultural omnium, On behalf of the families of the Turó del Drac school in Canet de Mar (Barcelona) who appealed to the courts regarding the application of bilingualism in the classrooms, filed an appeal for protection before the Constitutional Court against the ruling of the High Court of Justice of Catalonia (TSJC), ratified by the Supreme Court, which instituted, in application of the regulations and the Constitution, a subject in Spanish in one of the school courses.
According to the pro-independence entity, the intention is that after what the Constitutional Court says, which until now has always supported the linguistic conjunction model and not the mandatory immersion in Catalan as applied by the Generalitat, to address the European justice. In the appeal, reports Ep, Òmnium criticizes the fact that, from its point of view, there has been a “clear interference by the judiciary in an area of the legislative power, which is the one that enjoys democratic legitimacy to adopt decisions related to” the educational model and an attack on the competence of the Constitutional Court to control the constitutionality of laws.
In this sense, the entity considers that judges cannot decide on the educational model and, therefore, cannot determine whether it is legal or not. The president of the entity, Xavier Antich, expressed that the association will continue the fight “against a partisan court, which ignores pedagogical criteria and interferes with the legislative power to impose Spanish in the classrooms.”
Òmnium considers that, during the judicial process, families and the exclusively Catalan school educational model have been left unprotected before a court that, in its own words, acts as an anti-language activist and that “does not hesitate to break the laws approved by large majorities in the Parliament of Catalonia with the aim of eliminating linguistic immersion.

After hearing about the filing of the appeal, the Assembly for a bilingual school (AEB) indicated that the objective of the applicant entity is “the recognition that Catalan-speaking students have the right to study only in Catalan and to oppose the current model of bilingualism”, which would mean, in the eyes of the association that ensures the vehicular communication of the two official languages in Catalonia, “the recognition of the fact that Spanish-speaking students also have the right to study only in Spanish” and therefore “it would be necessary to establish a system of free choice of language: only in Catalan, only in Spanish or in both languages”.
