Popular accusations ask the judge to revoke Begoña Gómez’s passport

Popular accusations in the case of Begoña Gómez before the Court of Instruction number 41 of Madrid asked the judge to take away her passport, after she announced that she would not be in Spain next week, while she had been summoned to collect the last admitted complaint. for treatment, because she accompanies her husband, the president of the government, Pedro Sánchez, to the G20 summit in Brazil.

The petition, to which ABC had access, is signed by the representations of Vox, HazteOír, Iustitia Europa, Clean Hands, the Movement for Regeneration and Sergapp, all appearing in the case as popular accusations, before this defense brief which justifies his absence. due to the official trip to which she was invited by the First Lady of Brazil and to whom she has already confirmed her presence.

“From the document it is deduced that the person under investigation is not presenting a request to the court, but rather that it is a communication of no-show, a matter that not only represents a lack of respect and consideration in relation to the judicial power. but also the very consideration that he deserves different treatment from any citizen before the Justice, to which the popular accusations are categorically opposed”, reason the popular.

They argue that the resolution requested next week is dated October 28, before Gómez confirmed to the first lady of Brazil that she would attend the G20 summit and thus participate in the parallel agenda of the accompanying heads of state who were planned. In this sense, they emphasize that the defense has not justified “the imperative necessity of its presence” in Brazil and “should give absolute priority to the judicial summons over any professional or personal activity, as happens to any citizen”.

In this sense, they question the fact that “the dates of communication from the MAEC were not provided” when processing Begoña Gómez’s invitation to Brazil and that the attached document by which she confirms her participation in the G20 “lack of date, as well as the justification for sending the communication has also not been integrated.

A “personal” invitation

Furthermore, they emphasize that “the invitation is of a personal nature since it is even addressed to ‘Mrs. Begoña Gómez in her capacity as wife of the President of the Spanish Government”, it being understood that there is no special status for the wife of the President of the Spanish Government. “However, if the investigator considered that he did not have to personally deal with the legal request, he could perfectly well have filed the appropriate appeal within the procedural deadline set for this purpose, resolving the problem as quickly as possible and with the necessary guarantees,” they add.

They therefore understand that the demand is “unduly justified” and that “we deduce from this “a procedural act of bad faith, with late communication”. “They make us assume other intentions which, linked to the crimes under investigation, lead us to request measures of personal precaution”, say the popular accusations.

Concretely, they ask that he be prohibited from leaving the territory, that his passport be withdrawn and that biweekly appearances be imposed on him to guarantee his permanence in Spain, because, as they claim, “when a person under investigation plans to travel outside Spain, she must request authorization, and her request is analyzed, to justify the temporary lifting of this measure” and “what is extraordinary is that ‘a person investigated decides unilaterally that he will not appear, presents a writing to the Court, not to request authorization or exemption, but to directly express his impossibility and assume that he will leave Spain without further delay.
