Prosecutor’s Office Reduces Request Against Ana Duato in Nummaria Case from 32 to 22 Years in Prison

The prosecution reduced its request for a sentence against actress Ana Duato from 32 to 22 years in prison by withdrawing the charge for two tax crimes in 2016 and 2017 after verifying that in those years had less income for the series “Tell me how it happened” and, therefore, the sums allegedly defrauded could not be considered a crime.

As an alternative to this request – which also represents a reduction in the fines requested – anti-corruption prosecutor Tomás Herranz proposed to maintain the charge only for the years 2010 to 2012but only if the Court accepts the report that the Treasury presented at the start of the trial.

In this report, the Tax Agency states that the fraud from 2014 to 2017 did not reach the minimum of 120,000 euros to be considered a crime. The penalty would remain in this case 13 years in prison.

The prosecutor made these considerations in presenting his final conclusions. in the trial who is being sued against her, her husband Miguel Ángel Bernardeau (producer of the series) and her co-star Imanol Arias for alleged tax fraud through the Nummaria law firm, whose head, lawyer Fernando Peña, is also among the accused.

Given that Imanol Arias Having reached an agreement with the Public Ministry, the prosecutor limited himself to pointing out the changes that affect the rest of the accused, mainly regarding Ana Duato and her husband. In the case of BernardeauThe prosecutor stressed that if the aforementioned Treasury report were accepted by the Court, the producer of “Cuéntame comment s’est passé” would only have to answer for the 2012 tax.

The public prosecutor, for his part, also amended its request for sanctions in response to the said report of the Tax Agency and considers that Duato only committed a tax offence from 2010 to 2012, which withdrew the accusation for the rest of the tax years investigated.

Imanol Arias reached an agreement with the prosecution at the beginning of the trial in which he alleged fraud of around 2 million euros and accepted a sentence of two years and two months in prison -which does not imply your entry into prison-; while Ana Duato stood firm and chose to reject the accusation of the prosecutor, who until now attributed to her an alleged fraud of 1.9 million euros between 2010 and 2017 and requested a sentence of 32 years.

The trial will then continue October 23 with the conclusions of the defenses and the reading of the final reports
