Prosecutor’s Office rejects Begoña Gómez’s complaint against Judge Peinado for prevarication

The Public Prosecutor’s Office of the Community of Madrid rejects Begoña Gómez’s complaint against Judge Peinado for prevarication. The Prosecutor’s Office had to report on the admission for processing of three complaints filed against this same judge. He opposed the first of these, that of a journalist for the crime of revealing secrets. In the second case, that of the President of the Government for the offense of prevarication, he ruled in favor of admission.

Regarding the third complaint, the Public Prosecutor’s Office of the Community of Madrid requested that “complete” testimonies will be collected of the procedure on paper in order to have “full” knowledge of what was done before deciding on his admission to treatment.

As the Public Prosecutor’s Office reported this Monday, the rejection is due to the fact that “at this time and with the evidence and legal arguments provided in this complaint (…), “The legal budgets necessary for his admission to treatment are not planned.”because the higher court did not respond to the prosecution’s request to send it the full testimony of the case.

On October 1, the Civil and Criminal Chamber of the TSJM issued an order in which it rejected this request and asked the court to rule within five days on the admission of the complaint for processing. Faced with this refusal, the Prosecutor’s Office understands that “at this moment and with the evidence and legal arguments provided in this complaint (…), required legal budgets are not provided for admission to treatment.

This is the third complaint on which the Prosecutor’s Office expresses itself, which recently showed itself favorable to the admission to processing of the file filed by the Prosecutor’s Office against Judge Peinado for prevarication, it being understood that it cannot be excluded a priori that he has incurredn crime by issuing an “arbitrary and unjust” resolution. Previously, he spoke out against what the journalist Máximo Pradera had filed against the magistrate in charge of the investigation of Begoña Gómez, in his case for having revealed secrets during his reporting on the case.
