The defense of Rafa Mir, a Valencia CF footballer arrested for alleged sexual assault, has asked the judge to call the police to whom the girl confessed as witnesses, as well as the two arrested police officers who showed up at the player’s house after the event. According to a letter addressed to the Court of Instruction number 8 of Llíria to which OKDIARIO had access, Rafa Mir indicates that his testimony is “useful, necessary and relevant to clarify the facts”He asks to compare the testimony of the young girls with that of the local police officers who intervened in the altercation.
Rafa Mir was arrested last Monday after the events that occurred last Saturday at a party held at his home in Bétera (Valencia). Two girls, aged 25 and 21, whom he had met in a nightclub, reported having suffered a sexual assault and having been thrown out of the house half-naked. The Valencia player denies the facts and has claimed that the sexual relations were consensual. However, the Civil Guard arrested Rafa Mir and his friend and they were taken to court. The footballer, without prejudice to a subsequent qualification, faces a crime of sexual assault with carnal access and his friend to the same crime but without carnal access.
After studying the report of what happened, his defense requested that the agents of the local police of Bétera testify before the judge, because they spoke with the girls after what happened and even had a telephone conversation with them.It’s incomprehensible “Despite Rafa Mir’s prolonged detention, the Civil Guard did not collect statements from these public agents,” adds the footballer’s defense.
“Biased research”
His defense also believes that the Civil Guard carried out a “biased research”. Lawyer Jaime Campaner believes that Article 2 of the Code of Criminal Procedure has been violated, which states that “all authorities and officials involved in criminal proceedings will ensure, within the limits of their respective competences, to record and assess the circumstances both unfavourable and favourable to the alleged defendant.
Rafa Mir relies on the first report from the local police which exonerates him instead of in the Civil Guard report. This document reflects verbatim that one of the young women stated at the scene that the girl allegedly raped “went to the bathroom of the house consensually” with the footballer and that Rafa Mir knocked her over when he told her to stop.
Contradictions
Rafa Mir also told the judge that the alleged victims made blatant contradictions in their court statements. “He said that the woman told the police everything and that the others would not have known because they would be separated. Curiously, only two days had said something completely different in front of the Civil Guard” he explains. And remember what one of the alleged victims told the police station: “After telling the only local female police officer who was present everything that had happened, she said that Rafa Mir had stuck his fingers in her, under her impression that it “seemed like the male officers of the local police did not believe what they were saying, did not show much interest in finding out what had happened and even had a relaxed conversation with Rafa Mir while they laughed.
Rafa Mir released
The acting duty judge decreed in the afternoon provisional release with precautionary measures of Rafa Mir and his friend Pablo Jara, who was also arrested for allegedly sexually assaulting two women. None of the parties involved in the proceedings have requested the preventive detention of those arrested. In the case of Rafa Mir, the withdrawal of his passport and the ban on leaving the national territory are imposed. They will also have to appear in court every week and will be prohibited from communicating or approaching within 500 meters of the two complainants. For his part, the other detainee remains under investigation and the magistrate has imposed as a precautionary measure the ban on communication and contact with less than 500 of the two complainants and biweekly appearances in court.
