Former advisor Raül Romeva has chaired the ERC foundation, Fundació Irla, since January 2024, although he was disqualified by the trial judgment. The republican government of the time, chaired by Father Aragonès, registered it in the official register which depends on the Ministry of Justice, even if a disqualified person cannot be part of the board of directors of an entity of this kind.
According to El Periódico and La Vanguardia, the Irla Foundation claims that it named him president after the amnesty agreement. The rule came into effect in June, but has not yet been enforced. According to the Catalan Civil Code, a disqualified person cannot be part of the board of directors of a foundation. A condition that could also affect Laura Borràs, whom Junts named president of his new foundation. Although in the case of Borràs, the sentence is not final.
The sentence for his management at the head of the Institució de les Lletres Catalanes (ILC) is not final, but he is convicted of falsification of documents. However, others, after the Congress of Junts during which Carles Puigdemont assumed the presidency of the party she occupied, have now placed her at the head of the foundation that the formation will own. If she becomes president, she will join the board of directors.
Sources from the Ministry of Justice, now headed by the socialist Ramon Espadaler, assure that they will prepare a report on the legal situation of all foundations linked to the parties.
According to article 332-3 of the third book of the Catalan Civil Code, some of the conditions for being a patron of a foundation are not the prohibition from exercising public functions or managing property; as well as not having been convicted of crimes against property or against the socio-economic order or of crimes of lying.
