The colonel Diego Pérez de los Cobos renounced the execution of the judgments of the Supreme Court (TS), which canceled last July the promotions of three colonels of the Civil Guard and which agreed with the Minister of the Interior, Fernando Grande Marlaska. The objective of this decision is not to harm his colleagues in the Benemérita, given that, if the penalties were applied, three of the colonel’s colleagues would have to be demoted from their promotion to the rank of general.
The Milans del Bosch&ITL law firm, which is handling the legal defense of the colonel, emphasizes in a press release that Diego Pérez de los Cobos presented a brief on Friday before the Contentious-Administrative Chamber of the Supreme Court in which “he communicates that it is not right to demand the forced execution of the sentences pronounced by this court which They canceled the promotions of three colonels of the Civil Guard to the post of brigadier general, requesting his archives. Pérez de los Cobos presented a series of appeals in which he denounced that his candidacy had not been sufficiently evaluated for these appointments.
The colonel of the Civil Guard affirmed in his writings that “the three generals of the Civil Guard whose promotions were canceled by the sentences handed down –Francisco Javier Sánchez, Arturo Prieto and Antonio Rodriguez– that they are in no way responsible for the illegal behavior of the administration” and that they do not intend to affect the professional careers of these colleagues through “decisions traumatic which may be irreversible“.
For this reason, he informs the High Court that “he will not request the forced execution of sentences 1178/2024, of July 2, 1220/2024 and 1221/2004, of July 8, – the latter at the expense of the outcome of the incident of legal impossibility to execute the sentence pronounced by the State lawyer – dictated by this chamber, at the same time as request the file contentious-administrative appeals in which they were pronounced.
In addition, this Thursday we experienced another ruling of last October 29 in which the Supreme Court once again annulled an appointment within the Civil Guard, leaving without effect – at the request of another appeal by Pérez de los Cobos – promotion to brigadier general of the Colonel’s Armed Institute David Blanes. This is the colonel’s fourth victory against Fernando Grande-Marlaska.
