Sahroni hopes that the KPK will follow the Penal Code Act on the tapping, certainly not to disturb the performance

VICE chairman of the House of Representatives Commission III Ahmad Sahroni hopes that the Corruption Eradication Commission (KPK) Follow the drain rules as in Review of the Code of Criminal Procedure. Sahroni believes that the drain rules in the Code of Criminal Procedure will not interfere with the work of the KPK.

“We recommend that you follow the Code of Criminal Procedure, not to use other things, Pedomenal Criminal Procedure, it will be better,” said Sahroni when he contacted Wednesday (26-3-2025).

Sahroni is of the opinion that the KPK will not be disturbed by the drain rules in the Code of Criminal Procedure. He referred to the KPK work system.

“It will not be disturbed, the KPK has a good work system so far,” he said.

Sahroni assessed that the statement of the KPK that a specialist Lex would implement with regard to the tapping would actually become a polemic. According to him, if there are 2 laws the same, then what is used is the latest law.

“It will certainly be a new polemic if the Code of Criminal Procedure is still there, still used the old one, everything must participate in the Case Criminal Procedure Code, where the law always uses the last time if there is a change,” he said.

Nevertheless, the Nasdem DPP Bendum ensured that all parties, including the KPK, will still be invited for discussions regarding the Bill Language of the penal code that is still in the trial. “All parties will be invited to discuss it in order not to misunderstand and all in accordance with the expectations of the nation and the state,” he added.

KPK’s statement

The draft revision of the Act on the Code of Criminal Procedure (Ruu Kuhap) regulates the Drain issue, including the permission of the chairman of the court to the time limit for the storage of the drain results. The KPK claimed not to follow the regulation because the ticking was regulated by the KPK in the KPK Act.

The KPK said that the rule would not affect the tap through the KPK. The KPK said its authority was regulated in legislation number 19 of 2019 on the KPK.

“The KPK carries out the authority of investigating investigations and prosecutions based on the Code of Criminal Procedure, unless stipulated otherwise in the KPK Act. Until now, Lex is a specialist,” said KPK deputy chairman Fitroh Rohcahyanto, Monday (3/24).

KPK VICE chairman Joanis Tanak said that the drain rules for the KPK in the KPK law were regulated. He said that ticking into the draft law of the Code of Criminal Procedure is general.

“The ticking established in the Code of Criminal Procedure is more general because it can be carried out in every criminal case and can be carried out by the National Police Researcher and other researchers who have been determined in the legislation,” Tanak said.

He said that tapping the KPK was based on the KPK Act. The KPK, he said, did not follow the rules that were regulated in the Code of Criminal Procedure.

“Thus based on the principle of ‘Lex Specialist Derogat Legi Generalalis’ KPK has made on the basis of Act 19 of 2019 without the need to follow the provisions laid down in the Code of Criminal Procedure,” he said.
