Sanchez’s brother failed to remove his emails from the case: he appealed after the deadline

David SanchezThe brother of the Prime Minister, Pedro Sánchez, has appealed “outside the legally established time limit” against the decision of the investigating judge to order the seizure of his property. e-mails professionals.

So, barring any surprises, his attempt to ensure that the analysis of said emails does not take place is falling on deaf ears. At the beginning of July, Judge Beatriz Biedma ordered the Civil Guard’s Central Operational Unit (UCO) to seize Sánchez’s emails and various positions of the Provincial Delegation of Badajoz, for which the first one works.

David Sánchez’s defense had already tried to prevent the analysis of the emails, agreed on July 9 by the president of the investigating court number 3 of Badajoz. First, it did so through a call for reformwhich is filed before the magistrate who ordered it.

Biedma rejected it and maintained his decision. That is why the lawyer of Pedro Sánchez’s brother presented a callwhich must be resolved by the higher court to the Tribunal, the Provincial Court of Badajoz. Both can be presented together or separately.

Now, this second challenge …the call… occurred out of time. For this reason, the magistrate declared it inadmissible and did not transmit said documentation to the Court of Badajoz.

“In this case, the appeal should be dismissed [de apelación] filed whenever (…) dated August 5, 2024 is accepted by the attorney [del hermano de Sánchez] the notification of the order that decides the appeal for reform (…) and the presentation of the appeal is verified (…) on August 16, 2024, outside the legally fixed deadline of five days”, justifies the judge. This is what David Sánchez’s defense did several days later than expected.

And this is not the first time that the same thing has happened in this case, in which the brother of the President of the Government is being investigated for, among other things, the crimes of embezzlement of public funds and prevarication.

In a previous resolution, from last August, to which EL ESPAÑOL had access, Judge Beatriz Biedma criticizes that a call for reform signed by the defense of David Sánchez It was also submitted after the deadline. Specifically, it is the one with which he challenged the magistrate’s order to go to the Provincial Council of Badajoz to seize more. e-mailsbecause of a computer error occurred during your first visit.

The judge said: “[El recurso de reforma] must undergo a rejection spell. Firstly, she should not have been admitted to treatment, since she was presented outside the three-day period provided for by the Code of Criminal Procedure.”

As EL ESPAÑOL progressed, the UCO received emails from David Sánchez when he registered with the Provincial Council of Badajoz.

In concrete terms, the UCO agents seized all the e-mails that your account server has stored from the January 1, 2016. And not only his own, but also those of eight senior officials of the Provincial Council who, in one way or another, intervened in the process of hiring David Sánchez by the Badajoz administration.

In this way, they complied with what was ordered by Judge Biedma, who opened proceedings last May against the brother of the President of the Government after receiving a complaint from the Manos Limpies union, the same one that initiated the trial against Begoña Gómez, wife of Pedro Sánchez.

Since 2017, David Sánchez, musician by profession and known by the nickname David Azagrais hired by the Provincial Council of Badajoz as coordinator of the Badajoz conservatories, director of the municipal orchestra and project manager Young OperaFor this reason, he receives a salary of around 55,000 euros.

Clean Hands’ complaint accuses him of “getting paid without going to work”, when he did not authorize teleworking, and of not clocking in. However, the documentation sent to the judge by the Provincial Council of Badajoz justified these extremes by the fact that Azagra He occupies a “management position” for which remote work is not designed and does not require time monitoring.

It was the UCO itself that asked the magistrate to intercept the e-mails of David Sánchez and the eight officials. And so the instructor authorized it. That is why four agents went to the headquarters of the Provincial Council, as part of a separate element of the file that the magistrate declared secret.

In its complaint, Clean Hands reported that Azagra He resides in a mansion located in a Portuguese town, Elvas.near the Extremadura border, to pay less taxes.

The final report prepared by a commission of inquiry of the Provincial Council of Badajoz on this case confirms that Azagra taxed as a non-resident in Spain. Therefore, by residing in Portugal, you do not pay IRPF (Personal Income Tax), as stated in this document. The Treasury, responding to a request from the judge, sent a file that excludes that due to these events, Azagra committed a tax crime. Now the instructor has ordered the Ministry to let him know on which official signs there was an opinion.
