“There must be a regulatory update so that this program is truly inclusive and stable, and also provides proper benefits for Indonesian workers,” he said.
In the aspect of the membership of Eddi, it proposed a revision of Article 39 of Article 42 of Law No. 40 of 2004 on the National Social Support System (SJSN Law). The goal is that the program of pension guarantees (JP) can be available to all employees, including in the informal sector, and also require the participation of micro and small workers. He also encouraged a revision of Article 14 and Article 17 of the SJSN Law so that the government could bear JP contributions for poor and poor workers.
Eddie emphasized the importance of the immediate publication of state regulation (PP) as a derivative of Article 23 of Law No. 20 of 2023, concerning the ASN, to regulate social security management for the state civilian apparatus (ASN) through BPJS employment, including JP for ASN.
“This is important that the stability of membership is supported when someone moves the status from private workers in ASN, or vice versa,” he said.
From the point of view of advantages, Eddie proposed an increase in the calculation of the benefits in paragraph (2) of Article 17, concerning JP from 1 percent to 1.33 percent.
“This step belongs to the ILO Convention No. 102 of 1952, which recommends the advantages of at least 40 percent of the last wage with a period of 30 years,” he said.
Eddie also added that the advantages of retirement for the heirs of participants died, or participants who have experienced general defects remain determining at least 1.5 times from the poverty line, given that the current value of the advantages is still below the threshold.
“The government should also immediately increase JP’s fees so that the program does not experience financial deficit. This is part of ensuring the sustainability of national pension funds, ”he said.
In order to support compliance and transparency, Eddi suggested that the head of the employment inspection for employment BPJS receive a direct audit with the support of employees for employment from the Ministry of Workers. He also encouraged a comprehensive study of the possibility of consolidation between JP, the elderly and compensation for the film in the national saving system for old age, consisting of certain accounts of benefits and lump -sum payments.
