Yagub Raguf oghlu Hidayatov, a businessman against whom the Tax Department of the Ministry of Taxes (currently State Tax Service under the Ministry of Economy – ed.) filed a civil lawsuit for 1,515,139 manats, was acquitted.
According to information obtained by “Report”, he was acquitted and declared innocent in the trial presided over by Judge Alizamin Abdullayev at the Ganja Court of Appeal.
In addition, the mandatory restraining order against Yagub Hidayatov was canceled to prevent him from moving to another location, and the civil lawsuit filed against him by the tax authority remained pending.
The indictment against him states that the defendant did not submit a declaration to the tax authority while he was engaged in the activity of supplying and exporting fruit and vegetable products and avoided paying income tax in the amount of 1,515,139 manats to the State. . budget.
According to the ruling of the Barda District Court of January 27, 2022, he was found guilty under Article 213.1 of the Criminal Code (Evasion of large amounts of taxes, unemployment insurance, compulsory health insurance or compulsory state social insurance contributions).
According to the verdict, he was sentenced to two years of prison labor, with 20 percent of his income confiscated from the state, and was ordered not to go anywhere else. Furthermore, the tax authority’s civil claim against him was partially satisfied. Thus, it was decided to withdraw 102,053 manats from Yagub Hidayatov and pay them to the state budget.
Although parties dissatisfied with the verdict filed an appeal and a protest, the Ganja Court of Appeal rejected both the appeal and the protest.
The appeal court’s decision was subsequently appealed to the Supreme Court. According to the decision of the Supreme Court, the criminal case was returned to the court of appeal.
