The CES avoids Díaz with a nuance that vetoes the entry of the rival employers’ union of CEOE and Cepyme

The Economic and Social Council (CES), a public consultative body of reference in socio-economic and labor matters, vetoed the entry of territorial organizations like Pimec into its management bodies through a nuance in the regulations approved today by its advisors which excludes regional organizations integrated into a state federation or confederation. The Catalan employers’ association is part of Conpymes, which operates at state level and aims to compete with CEOE and Cepyme, the latter being the main employers’ organizations with national representation.

The detail that the CES included in the modification of article 4.3 of the regulation, approved unanimously. “The employers’ organizations which enjoy the most representative status at the regional level will be represented, excluding in this case those which are integrated into federations or confederations at the state level”, indicates the new article, as stated learned ‘elEconomista.es’. . The Official State Gazette (BOE) will soon include this change reflected in article 2.3 of the Workers’ Statute.

SO, saves the order launched by the Second Vice President and Minister of Labor, Yolanda Díazwhich forced the CES to reform its regulations through a decree on unemployment compensation. Labor has requested the incorporation of the most representative employers’ organizations in each region, while the CES incorporates the aforementioned condition put forward by “ABC”, which excludes the cases of Pimec in Catalonia or Pimeb in the Balearics.

The president of the CES, Antón Costas, later confirmed that Díaz had maneuvered behind the back of the organization during a meeting with journalists to present its traditional annual report. “We would have liked this to have been agreed in the social dialogue and consulted with the CES, as is the case in the regulations,” he then declared. A movement that not only hurt Diego de León 50, headquarters of the CEOE, but the unions also felt that it broke the “status quo” of social dialogue.

The CES is made up of 61 members, including its president. Among them, 20 represent trade union organizations (first group), 20 business organizations (second group, where the CEOE and Cepyme are located), and 20 other sectors: three the agricultural sector, three the maritime-fishing sector, four consumers and users, and four to the social economy. The remaining six members are experts in areas falling within the competence of the Council.

The Catalan Pimec, pro-independence, or the Balearic Pimeb, are part of the entrepreneurial organization Conpymes, born in 2021 with the public support of Begoña Gómez, the wife of Pedro Sánchez. Until now, the status of “most representative” (15% of companies) was accredited by both in their respective territories, where they are recognized as interlocutors.

The CES expressly recognized the functional independence of the General Administration of the State, as well as the organic and functional autonomy for the achievement of its objectives, which gives it the power to regulate its internal organization and its operating regime. The Council is administratively attached to the Ministry of Labor and Social Economy headed by Díaz.
