JAKARTA – The Chairman of the Indonesian Commission on Constitutional Research MPR (K3), approved the Basari Taufik, the term of powers of the DPRD cannot be extended to fulfill the decision of the Constitutional Court (MK), which is divided between local elections and national elections.
Tobas, his nickname, said that the expansion of the term of office of DPRD can violate the constitution. The reason, according to him, in article 22E in paragraph 2 of the 1945 Constitution (UUD) will be held every five years.
But if the position is empty, it is said that this will violate clause 2 and 3 of Article 18 of the 1945 Constitution, which requires the regional government to have a DPRD.
“DPRD was chosen for the election, there was no other way,” Taufic said at a joint hearing of the III representatives of representatives in the parliamentary complex, Jakarta, on Friday (4/7/2025).

In addition, Tobas’s bet, decision of the Constitutional Court No. 135/Puu-XXII/2024 is a decision on the dilemma. The reason, according to him, the decision can lead to a constitutional crisis or a constitutional impasse.
