The Provincial Court of Madrid decided this Monday to partially accept the appeals presented by the defense of Begoña Gómez and the prosecution against the investigation opened against the wife of the president of the government, Pedro Sánchez, for alleged crimes of influence peddling and commercial corruption. In their order, consulted by OKDIARIO, the magistrates of Section 23 specified that the investigation by the Court of Instruction Number 41 of Madrid we must leave aside the blockage linked to Globalia and the rescue of Air Europathe judge can therefore only continue to investigate the chair of the Complutense University of Madrid and the suspected contracts.
Initially, the deliberation was scheduled for September 30. But that day, the magistrates realized that the call was missing presented by the defense of Begoña Gómez, which forced the suspension of the session. Initially, it was expected that deliberations would not resume until “three or four weeks”, according to legal sources. However, plans changed and the deliberation and decision were postponed until Monday.
The defense of Begoña Gómez, led by the former socialist minister Antonio Camacho, requests the complete file of the case, alleging that Judge Peinado’s investigation goes beyond reasonable limits. According to Camacho, the judge performs what he describes as a “universal search”affirming that the order issued by the magistrate indicates that all aspects related to Gómez are under investigation since her husband assumed the presidency of the Government. The only limit imposed on this investigation are the facts included in the initial complaint of Manos Liminas and those which fall within the exclusive jurisdiction of the European public prosecutor’s office.
For its part, the prosecution agrees that the judge orders a “general cause” but his request to the Provincial Court of Madrid is that delimit the subject of the investigation, by focusing the investigations on concrete and specific facts.
Possible results
The Provincial Court was faced with three possible scenarios: continue your research as it stands, rejecting both appeals; accept the appeal of the prosecution and refine the aspects studied; either deposit the case, as requested by Gómez’s defense. This decision will be made by three magistrates, since the former Minister of Justice Pilar Llop, currently assigned to said section, withdrew from the deliberations. The presentation of the file will be the responsibility of the magistrate Enrique Bergés de Ramón.
It is important to note that beyond what the Provincial Court decides on the facts investigated so far, which also involve the businessman Juan Carlos Barrabés and the rector of the Complutense University of Madrid (UCM), Joaquin Goyache, Judge Peinado has a new complaint on his table against Begoña Gomez. In this latest charge, he is accused of having appropriate software developed by the Complutense University of Madrid, which adds another aspect to the ongoing judicial process.
