Justice closed the case opened for the extortion suffered by the cartoonist Francis Montesinos, who was convicted of the minor who had trapped him to obtain money after confirming that his story was false.
Juvenile court number 4 in Valencia condemned 24 months of confinement to the minor who extorted the Valencian creator with a sex video in October 2022.
The 24 months of confinement will be carried out in a semi-open regime, divided into 18 months of effective confinement and six months of supervised release. The sentencing resolution, consulted by EL ESPAÑOL, includes three continuous crimes of threats, one crime of invasion of privacy, one crime of theft with violence and two minor injuries.
In the meantime, the second minor was sentenced to seven months probation for a continuous crime of threats. In matters of civil liability, the first minor must compensate Montesinos with 5,000 euros plus legal interest.
The two men admitted the facts to avoid holding the trial, scheduled for September 26, and obtain a reduced sentence.
The events date back to September 2, 2022. On that day, one of the convicted minors obtained Montesinos’ cell phone through an adult and began sending him messages on WhatsApp. In these messages, she told him that she knew him by sight because she passed his studio door several times, that he was very handsome and that she adored him.
He told him he was 18 and repeatedly expressed his desire to meet him.
Apparently, little by little he gained Montesinos’ trust until he invited him to his home located in the Valencian municipality of Llíria.
The minor attended, at least, September 5 at home under the pretext of helping him move and the next day they ate together. They then went up to the room where they had sexual contact recorded by the minor without the consent or knowledge of the designer.
Messages
Once the minor got what he wanted, around 8:30 p.m. the same day, with another adult, they sent him videos of the sexual relationship to his cell phone and asked him to pay one million euros for do not make them public. . Montesinos saw the messages the next day and told them he was going to report it to the police.
The minor then told him to pack his bags to go to prison because he was a 15 year old boy and “you abused me“.
From that moment, and since the designer did not comply with his requests, they sent him audios and messages in which they told him, among other things, that they were going to publish the video on social networks and that They were going to report to the police station for abuse and rape. They also told him that they had contacted the collaborators of a television show.
In the absence of answers, September 25the minor entered Montesinos’s house taking advantage of the fact that the door was open, he went to his room, woke him up and told him that “I came to solve the problem“.
The designer told him that he had no money and that the minor had left the premises when the automatic lights in the garden had turned on and out of fear that someone would arrive.
By not accepting his requests, the minor planned, together with the adult, to teach Montesinos a lesson, and they provided two people with the designer’s information so that they could access his house, which they did. October 2. They entered with their faces covered and attacked him with a stick to the head and shoulder, then tied him up with zip ties.
Then they began to search the room, telling him “the gold, where is the gold”, and later they asked him 500,000 euros not to broadcast the video because otherwise they were going to kill him. However, they heard a woman screaming and fled the scene without achieving their objective.
Montesinos was investigated and acquitted of alleged sexual abuse of a minor. The procedures carried out did not prove proof of a crime.
Second extortion
