On Wednesday, October 30, two deputies presented a bill, supported by the Government, aimed at suspending the prohibition on renting high energy consumption homes in co-ownership when a blockage occurs that does not depend on the will of the owner.

This text is in line with the Government’s desire to adjust the calendar of the Climate and Resilience Law for co-ownership, and the Ministry of Housing and Urban Renewal has indicated to the press that it supports this bill.

The Climate and Resilience Law establishes that energy-intensive homes classified G in the energy performance diagnosis will be prohibited from renting from 1Ahem January 2025. Then it will be the turn of homes classified F from 2028.

In detail, Ensemble pour la République (ex-Renaissance) deputy Bastien Marchive and socialist deputy Iñaki Echaniz propose that G-classified homes not be removed from the rental market if thermal renovation works are being carried out and if there is a blockade. within the co-ownership or by the tenant.

This transpartisan text aims “offer flexibility” to co-ownership, “maintaining the course and schedule and preserving the interests of tenants”assures Iñaki Echaniz, quoted in a press release.

The two deputies also plan “the possibility of the judge reducing the rent based on the amount of energy costs, as well as the exclusion from this system of homes classified G+, especially those that consume a lot of energy” and its rental has already been prohibited since January 2023.

Avoid “permanent avoidance”

A period is foreseen for the suspension of the ban on renting energy sieves in a specific case: if the thermal renovation works have been voted on at the general meeting of co-owners, the period to carry them out is three years, stated the socialist group. in the Assembly, he told Agence France-Presse.

To prevent the lack of voting in a general assembly from leading to “a lasting bypass” obligations to improve the energy efficiency of homes, it is proposed to integrate thermal and energy renovation measures into the multi-annual work plan of the co-ownership.

According to ministry figures, included in the transpartisan text, up to 250,000 homes located in co-ownership and classified G could be affected by the rental ban from 1Ahem January.
