The judge of the investigating court number 5 of Valladolid who is handling the case of disappearance and death of Esther López, issued an order by which it was agreed to open the procedure for the popular jury trial of Óscar, the only one that was investigated.
In the said decree, signed on October 16, 2024, the opening is agreed for the offenses of murder/homicide and omission of the duty of assistance, among others, as dictated by the document to which EL ESPAÑOL de Castilla y León had access.
The judge informed the prosecutor, the private charges and the president of the Valladolid court. He also asks to inform the accused letting him know that he must appear at the appearance with the assistance of his lawyer.
It is indicated for the obligation hearing on December 20, 2024, at 11 a.m., in the courtroom of the said court of Valladolid.
The facts investigated cover, for the moment and without prejudice to subsequent details, “the characteristics of murder for private prosecution” and of “murder/homicide and non-assistance to the prosecution”without prejudice to other possible qualifications such as a crime against moral integrity, road safety, etc.
The ditch in which the body of Esther López appeared
It is up to the Jury Tribunal to hear both crimes against life and breaches of duty, in accordance with the provisions of art. 1 of LO 5/1995.
With this, the judge ends the investigation and transmits the order to the prosecutor’s office along with the accusations so that he can formulate them. Óscar, already indicted, will appear in the dock for one crime of homicide or murder and another for omission of the duty of assistance.
A fateful January 13
The judge’s order comes after she rejected yesterday, for the second time, Óscar S.’s request to recollect the statement of the expert who evaluated his vehicle.
The judge, who had already rejected this request on September 23, argued that the fact that the expert handed over all the documents on which he based his report after the appearance in court “does not affect the results of the diligence carried out.”
The disappearance of Esther López at the fateful dawn of January 13, 2022 This shocked the whole society, not only in Valladolid, but in the whole country. His body appeared lifeless on February 5 of the same year in a ditch on the N-122 which leads to Traspinedo.

After the death of Traspinedo’s wife, as the Civil Guard report shows, Óscar allegedly took the young woman’s body. to the ditch where he was found.
