The Court of First Instance and Instruction number 2 of Posadas decided to continue the investigation opened against seven young sub-Saharan Africans after having collected the statements of the complainant of a gratedband in May 2023 in Palma del Río.

The Superior Court of Justice of Andalusia (TSJA) has informed ABC that the case is ongoing research phase by the investigating judge who is awaiting the results of two expert opinions in this case.

Initially, the Court of First Instance and Instruction number 3 of Posadas, acting as guardians, accepted, just two days after the filing of the complaint and the judicial detention of the seven detainees, “the provisional release of the seven men detained by the Civil Guard” as part of the investigation into these events.

The events reported date back to May 13, 2023 in the house they share these sub-Saharan day laborers to whom the young woman had gone voluntarily because she had a relationship with one of them in the town of Vega del Guadalquivir, as ABC learned from sources during the investigation.

The investigating judge, after hearing the detainees, then released the seven temporary workers with charges after the police themselves. Prosecutor’s Office did not request his admission to prison, considering that there are no compelling reasons so far it is enough to request this preventive measure to the detriment of the progress of the investigation since they must hear the testimony of the complainant in court and receive the results of the forensic analysis.

Declaration by videoconference

The victim, who did not initially testify because she was “shocked”, as reported by various sources in the case, did so on September 27 to video conference with the court itself, sixteen months after reporting the facts to the civil guard station in Palma del Río.

The prosecution had requested, as a precautionary measure, for the detainees, who remain on provisional release, the withdrawal of their passports since they were immigrants until they were clarify their possible participation in the events. As a precautionary measure, they are therefore prohibited from exit from the territorynational, also having the obligation to appear in court every Monday.
