National Court Judge José Luis Calama refused to appoint a judicial administrator to temporarily control companies linked to Álvaro Romillo.
This crypto-entrepreneur was denounced for fraud by dozens of investors who had trusted one of his companies, Madeira Investment Club (MIC), which, surprisingly, closed its website a few months ago and the expected economic benefits have ceased.
Likewise, Romillo paid 100,000 euros in cash to current MEP Alvise Pérez to finance his electoral campaign 9-J. In exchange, as the businessman told the prosecution, the politician and agitator pledged to promote his businesses and investments in crypto assets from the heart of the European Union.
After admitting the various complaints of fraud against Romillo, Judge Calama opened an investigation at the beginning of last October.
Shortly after, the Cryptocurrency Users Associationwho filed one of the massive complaints that gave rise to the legal proceedings, asked the magistrate to appoint a judicial administrator. Concretely, he offered to be one of the partners of the Aránguez Abogados law firm, to which the data subject platform is attached.
But the judge rejects this possibility. He considers it premature and poorly justified.
“In this case, whatever the initial state of the investigation, it is difficult to assess the hypotheses according to which the adoption of a precautionary measure of the nature of the person concerned, the applicant [la Asociación de Usuarios de Criptomonedas] limits to interest its adoption in a completely orphan way“, criticizes Calama.
“Therefore, there is no need to adopt the precautionary measure in question taking into account the nascent state of the present investigation, as well as the defective request presented for this purpose, without prejudice to the fact that the request may, if necessary, be presented again in compliance with legal requirements and once the investigation has advanced”, he adds, in a resolution of 31 and which he had access to EL ESPAÑOL.
As this newspaper reports, Romillo himself, who placed his property at the disposal of Justice, supported the appointment of a judicial administrator for his businesses, which include, among other things, the organization of a festival of music with world-class stars and several restaurants. chains.
Recently, the magistrate added to this procedure the complaint filed by Romillo against Alvise, in which the businessman provided the aforementioned conversations with the politician and agitator. These messages accredited the handing over of 100,000 euros in cash that Pérez allegedly allocated to his 9-J campaign.
The instructor actually suggested to Alvise voluntarily declare to the National Court on November 20as well as providing documents, proposing investigative procedures and participating in the investigation of the case. But as Pérez is a European deputy, only the Supreme Court, before which he has jurisdiction, could investigate him and summon him to testify in this capacity.
For the moment, Calama, to investigate the possible crime of illegal party financing, has opened a separate room in this case, different from the main one, in which he is investigating the alleged MIC scam.
