The National Court confirmed the two years of disqualification imposed on the former president of the Royal Spanish Football Federation (RFEF), Pedro Rocha, according to the sentence examined by Europa Press.
Rocha was “sanctioned for three very serious infractions” by the Administrative Sports Tribunal and his first appeal ended up being rejected by a judge last September. Rocha thus hoped to be able to run in the RFEF elections.
The former Spanish football president announced at the time a legal battle to be a candidate in the imminent elections. This week representatives were elected to the assembly who are then responsible for choosing a president. This battle ended in a total defeat of the aspirations of Luis Rubiales’ successor – forced to resign over his non-consensual kiss with Spanish national team player Jenni Hermoso –
The court affirms that the offenses “have in common, indicatively, the exercise of powers which do not correspond to it, in accordance with the regulatory regulations of the Federation, ignoring the internal rules of operation and depriving the governing body of decisions with full knowledge of its exclusive nature. skill”.
This is why, add the magistrates, “it is possible to think that if the precautionary measure is accepted and the person concerned continues to occupy the position of president of the RFEF, there is a real risk that these behaviors will recur with the consequence of serious injuries. to the legal assets that disciplinary regulations attempt to protect.
The Chamber also emphasizes that “the sporting values of honesty and respect for the rules which are intended to be projected onto the whole of society require the proper exercise of powers and management functions by the people entrusted to them, which precisely because of the influence they exercise as representatives of these organizations on the social body, they must be particularly respectful of respect for the rules.
“It is not consistent with this objective, in the opinion of the House, that a person who has been disqualified as President for non-compliance with these rules should be allowed provisionally to retain said position and to be able to run in a electoral process after having been sanctioned for behavior constituting a serious attack on these values, to the extent that they come up against impartiality and respect for the rules”, conclude the magistrates.
