The administrative court of Paris validated, on Friday, November 22, the possibility of holding a conference to welcome MEP Rima Hassan, who had filed provisional measures on November 20. The event, which was to be dedicated to the issue of the embargo on arms sales to Israel, this Friday afternoon, was canceled by the management of Sciences Po Paris, which feared “disturbances of public order”.
The administrative judge suspends the ban taken on November 18 by the director, Luis Vassy, and orders the Paris Institute of Political Studies to schedule a new date for this conference, on condition that the collective of student organizers Students for Justice in Palestine, presents the necessary guarantees for its proper functioning, in particular with regard to the security system and moderation of debates.
For the judge, “It does not appear from the investigation that the possibility of disturbances related to the counter-demonstrations is of such severity that they could not have been prevented by police measures with less interference with freedom of assembly and ‘expression than the controversial ban.’.
By refusing to authorize the planned conference, the director “ensured a manifestly illegal conciliation of the inherent limitations on his powers”, which are to guarantee respect for freedoms in the establishment and ensure its independence from any political or ideological influence, and maintain order in its premises. METROme Hassan is therefore “founded to maintain that this refusal constitutes a serious and manifestly illegal attack on freedom of expression”.
“Opening school”
At the beginning of the year, the Council of State had already had to decide the question of a conference that would host M.me Hassan at the Paris-Dauphine University. On May 6, he considered that the reality of the threats of public order disruption had not been proven and authorized the intervention of the Franco-Palestinian lawyer – who was then a candidate in the European elections of June 9, and who is also the target. of an investigation for apology of terrorism, for facts that he questions.
