This is the first step to carry out the reform of the law regulating the right of association, which affects one of the fundamental rights protected by the Constitution. It is included in Article 22, Title I of the Constitution, which regulates fundamental rights and public freedoms. Thus, the law on associations which wants to be reformed is an organic law. And, therefore, it requires an enhanced majority for its approval. An absolute majority is required, a simple majority is not enough, which is sufficient for the approval or reform of an ordinary law.
The PP announced that, when this project is examined by Congress, it will make amendments to readjust the text proposed by the socialists. Among the members of the PSOE, in the case of the pro-ETA members of Bildu, they also announced that they would present amendments so that the scope of these restrictions on the right of association would be broader than those envisaged in the text promoted by the party of Pedro Sánchez. party.
The Spanish Constitution, in its article 22, proclaims the right of association with the only limit that the entities do not pursue “ends or do not use means qualified as crimes”. And it specifies that “associations can only be dissolved or suspended in their activities by virtue of a reasoned judicial decision”.
