The Granada Provincial Prosecutor’s Office has requested up to two years in prison for two accused of harassing a trans person. The prosecution, which considers it an offense against moral integrity and requires one year and three months in prison for one of the accused and up to two years in prison for the other, considers it proven that the couple, aged 49 and 58 years old, harassed the victims for the purposes of “annoyance” and “intimidation”. Something that also happened when the victim was in a transition process to change gender. According to the prosecution in its indictment, the two accused contacted her precisely because of her condition as a transsexual.

At the time of the threats, the victim was advertising on various websites offering her masseuse services. Websites both defendants accessed to contact her. Once they got his cell phone, they asked for photos, his geolocation in a town in Granada and that’s when the humiliating messages began: “Let’s see, fucking transvestite, you have two days to leave. “I live nearby and you’re making me sick.”

The sequence of messages, via WhatsApp, to which this media had access, took place on January 16, 2022. Although the victim told them that she was going to file a complaint and that she was going to the barracks to do so, the accused continued to intimidate him. “I have the location and I have no idea how you ended up here. There are children living in this town and there will be no fucking transvestites in my neighborhood.

“I will put the picture of your face and location on Facebook,” they wrote even though the victim insisted she would report them. To which one of the accused replied “that makes my balls sweat”, adding that “in the same way, we will go looking for you to expel you from our neighborhood”. The defendants, for whom the prosecution is requesting prison sentences, wrote to him that “there were not enough of them in this world” or that there were “children and respectable people” in the city and that ‘he had to leave.

The threats were not limited to written messages, but they sent him an audio from a neighbor in the city in which she considered the victim “disgusting”. The next day, January 17, after sending messages on his phone, one of the accused showed up at the complainant’s home, walking around in his car and getting out of the vehicle. At that point, he looked out the window and showed the victim the WhatsApp conversation, seeking to intimidate her.

For all these reasons, the public prosecutor notes two crimes against moral integrity for which it requests prison for both. At the same time, he requests from the Provincial Court of Granada a fine of nine euros per day for nine and six months respectively, the ban on exercising any profession related to the work of teaching, as well as the impossibility of voting in elections. while the sentence lasts.

The trial is expected to take place on November 14 at the Granada Court, once the complaint has been admitted for processing and the Public Prosecutor’s Office has sent its indictment.
