Liputan6.com, jakarta – Indonesia Association of Lawyer-Suar Indonesian lawyer (Paradi Sa) expressed its gratitude to the Commission of the House of Representatives of the III and the government for the positive response to the aspects of the Community of Lawyers when discussing the draft Criminal Code (Rkuhap).
At a discussion meeting held on Thursday (10/7), the commission of the III House of Representatives and the government agreed with two important moments for which they had long fought lawyers. Firstly, the existence of immune rights to lawyers, as legal protection in the implementation of their profession.
Secondly, the existence of the protection of rights to apply for objections if the investigator scares and/or asks questions that will record the suspect. The objection should be recorded in the exam protocol.
The chairman of Paradi Sai, Juniver Girsang, said this decision was an important moment in the history of the reform of the criminal justice system in Indonesia.
“Protection of the profession of a lawyer is an integral part of a fair and accountable law enforcement agency. Immunity does not mean unlimited immunity, but legal guarantees that defenders can work without fear, without pressure and without the risk of criminalization of their professional duties, ”said the Juniver.
The Juniver also emphasized that it should be respected as part of legal control in the investigation process to protect the courage during the exam. An official registered objection is a form of verification and balance for the possibility of abuse of power.
