The Supreme Court of Russia supported a Murmansk resident who issued a credit card with the right to withdraw cash without commission. But then the bank unilaterally changed the terms of the agreement and introduced a commission for such actions. Now, as RIA Novosti reports today, October 29, financial organizations will not be able to carry out such actions.
In the initial appeal to the court, the man was rejected, since the bank’s right to unilateral actions was established in the contract. Additionally, the trial judge pointed to the fact that the credit card is designed specifically for non-cash payments, and cash is a separate property benefit.
But the Supreme Court decided that such a condition of the contract is void: “Neither the Law on Banks and Banking Activities, nor the Law on Consumer Credit provide for the right of the bank to unilaterally change the terms of the contract and increase the amount of commissions or introduce new commissions, since such changes imply an increase in the size of monetary obligation of the borrower under the consumer loan agreement)”.
