The Criminal Court 4 of Cordoba was suspended barely 48 hours before the trial against fifteen activists who stoned a dozen civil guards who tried to prevent them from entering private property in Hostels in 2007. This is the third time that this trial has been postponed, in which these defendants face sentences totaling more than 40 years in prison since one of these agents lost an eye.
The prosecution had requested sentences against them totaling 2 years and 8 months in prison for each of the 15 accused -around 40 years in prison in total- and fines amounting to 67,500 euros for this group which participated in a rally to defend the public nature of the Los Torrilejos laundry.
In its memorandum of provisional conclusions, already put forward by ABC, the Prosecutor’s Office recorded how, in the afternoon and night of September 14, 2007, the agents deployed a safety cord at the gate of private property following the announcement that this group of people intended to enter, in order to maintain public order.
Once there, the accused, having agreed to carry out a preconceived plan, despite the presence of agentsThey began to berate the security cordon, claiming that “the force had been bought by the owner of the property and that they would pass anyway, since the road was public.”
Immediately afterwards, after unsuccessfully forcing the security cordon, the officers were subjected to multiple pushes and blows with the umbrellas and canes they were carrying, breaking some pliers the fence of an adjacent property and penetrating inside the road.
Once on the hill along the road, ignoring the officers’ orders, they started throwing blows at them. stones and bricks large dimensions that they not only found on the road, but that they also took with them in their bags or backpacks to the place provided for this purpose with the certainty of reaching them, given that ‘they did it a short distance away. In this action they reached 9 agents.
The public prosecutor also claims that the accused threw stones at the official vehicles sent to the scene. Three of them suffered damage, for which the State Attorney claims, which were valued at 1,133 euros, almost 984 euros and 685 euros. In addition, one of the SBS defendants hit an officer and snatched the official police radiotelephone, worth 510 euros and which could not be recovered.
In the prosecutor’s account, it is also specified that given the exaltation of the spirit of those gathered, the agents had to fall back at the back of official vehicles, having to use riot gear to repel the stone throwing that continued at them.
Undue delays in 17-year-old case
The Prosecutor’s Office is requesting against these defendants, for whom it is considering a very nuanced mitigation of the excessive delays – 17 years after the facts – sentences of 5 months in prison for the offense of disturbing public order, of one year prison for serious attack to authority; six months in prison for the three injury offenses committed by each; as well as an additional 9 months in prison for the offense of damage. At the same time, one of the accused is also accused of the crime of theft.
The trial which was to take place from this Wednesday, November 20 has already been suspended the last time by the Criminal Court Number 4 of Córdoba in February 2022.
