The Superior Court of Justice of Andalusia (TSJA) rejected the appeal presented by the platform Mosque-Cathedral against the removal of the trellis which made it possible to open the second door for the passage of the brotherhoods during the official race of Holy Week in Cordoba. This was confirmed by the Association of Brotherhoods.
He thus gives reason to Audience of Cordoba, who assured that the decision canceling the authorization of the Ministry of Culture for the project had been executed “in its entirety” and that therefore the grid removed in 2017 could not be replaced.
As happened in the judgment of the Court of Córdoba, it is insisted that the platform, which since its creation demands that the property of the Mosque-Cathedral be removed from the Catholic Churchis not directly affected by the decision, so it is not up to you to make the request.
“The interest that arises from its ideology or its statutes does not give it legitimation be able to request the execution of another’s sentence”, specifies the TSJA. It also specifies that the trellis from the 70s cannot be restored, because “it was not affirmed in the process nor declared by the sentence” .
There are several reasons, and one of them is that “the Cathedral Chapter was not sued, the one who initiated the protected procedure” by a building permit which was subsequently canceled in a process followed without his hearing or intervention. “There is little interest in the appellant association appearing in the proceedings already initiated,” insists the Superior Court of Justice of Andalusia.
The platform’s desire to restore the trellis and therefore to use a second gate thus once again suffered a setback after the victory of the battle to cancel the permit that the Ministry of Culture of the Junta de Andalucía, still at the time of the PSOE, had been granted to allow the opening. It remained to be seen how to act, but the courts concluded the problem was that it was impossible to replace him.
