The two young women “fought among themselves” and a complaint was filed “out of jealousy”.

Rafa Mir said this Wednesday before Judge Ana Magraner Naya, president of the Court of First Instance and Investigation number 8 of Llíria, for the alleged sexual assault against a 21-year-old woman in the early hours of Saturday to Sunday last.

The Valencia CF footballer, according to the statement that EL ESPAÑOL had access to, acknowledged “sexual relations with the complainant and with her friend”, but assured at all times that “have been agreed“.

Mir also said that the girls had “a confrontation between them caused by jealousy,” having had relations with both of them that night. According to their version, they were both kicked out of their house by their friend Pablo Jara, due to the altercation they had caused.

The statement by Rafa Mir, to which this newspaper had exclusive access, met the two girls on Saturday night at the Mya nightclub, located in the City of Arts and Sciences in Valencia.

In this famous nightclub, Rafa Mir kissed the complainant, 21 years old. The footballer was with two friends and the five decided to continue the party at the player’s home, located in an urbanization of Bétera, a municipality near the capital.

Rafa Mir returned home by taxi with the two women. His friends did so in another vehicle. During the journey, the player kissed the friend of the alleged 25-year-old sexual assault victim.

This caused, according to the version given by the footballer in court, a fight between the two women. Finally, the taxi ride continued and the now complainant decided to go to Rafa Mir’s house, even though he was going to have relations with his friend.

Upon arrival at the chalet, the footballer had consensual sexual relations with the 25-year-old girl. According to sources in the case, these relations were also acknowledged by both women and confirm that until that moment there was no punishable act on the part of Rafa Mir.

The versions differ with what happened later. According to the accused, after having relations with the first young woman, he went to the garden and met the friend, who was very upset by what had happened.

After some “partying” – according to sources – the Valencia CF footballer threw her into the pool “as a joke” and, by mutual agreement, they began to kiss and touch each other, always according to this version.

Rafa Mir also admits that he went back up to the bedroom with her to have sex and that it was at that moment that he inserted his fingers into her vagina. The complainant, aged 21, claims in her statement that this happened without her consent and that it was the moment of the sexual assault.

The Valencia CF player claims that while they were kissing and touching each other, the young woman with whom he had previously had sexual relations started banging on the door and screaming.

It was then that, according to the footballer, an altercation took place between the two. Pablo Jara, a friend and player of Alcantarilla, intervened during the Tercera RFEF and decided to throw them out of the house because of the shouting they were doing.

Kicked out of the chalet

Rafa Mir does not deny that Pablo Jara threw the clothes of the two plaintiffs over the fence. In fact, he blamed his friend for it. However, both footballers deny that Jara hit one of the young women.

At the time they were being evicted from the chalet, the municipal police of Bétera arrived after receiving calls from neighbors.

Before the Municipal Police, the sources of the case assure that none of the girls reported having suffered a sexual assault. For this reason, the agents did not make any arrests.

The prosecution supported the release of Rafa Mir requested by his lawyer, Jaime Campaner. The lawyer, managing partner of the renowned Campaner law firm, offered to hand over the footballer’s passport to ensure that there was no risk of escape.

Campaner has defended important figures such as the former first lady of Peru –Nadine Heredia-, Calum Best -son of footballer George Best-, Mustafa -also Valencia CF player- or Salvador Trixet -advisor accused of organizing the corporate structure of Iñaki Urdangarin and his partner Diego Torres-.

Finally, the judge decided to release Rafa Mir with the following precautionary measures: withdrawal of his passport, prohibition on leaving Spain, weekly court appearances and a 500-meter restraining order against the two plaintiffs.
