In her letter sent to the Court of Instruction 5, requesting the transformation of the procedure into a jury procedure, the public prosecutor in the case of the disappearance and subsequent death of Esther López considers that there is sufficient evidence to place the only one under investigation, Óscar, in the SM dock, including maintains that, for unspecified reasons, crushed the victim then I left her to die.
This account of events included in the Attorney General’s letter sent to the court, to which Europa Press had access to legal sources, is based on the indisputable fact that the lifeless body of Esther López De La Rosa was found on 5 February 2022 on the VP-2303 road, KP 0.7/0.8, ditch on the right towards Traspinedo, at the height of a road sign “overtaking authorized”.

The public accuser continues her reconstruction of the events, claiming that Óscar left after her in his vehicle, with which he ran over her very close to this building, causing serious injury, but not death.
“Knowing that Esther was alive, Óscar, far from providing help or asking for the help that others could provide, He waited between one and three hours until he realized she was already dead, before hiding the body, and finally put it in the trunk of his vehicle and threw it, hours later, where it was found, without giving direct or indirect information about its whereabouts.

“From this linear narrative, there is sufficient evidence to accuse Óscar SM of the events described, which may constitute an offense of murder or intentional homicide (138 to 140 PC) and/or an offense of omission of the duty of assistance (195 and 196 PC), both being within the jurisdiction of the jury court, and other crimes may also be imputed, such as a crime against the moral integrity of art. 173 1 CP, of an offense against road safety etc…”, he concludes.
