He Higher Council of Sports Last Friday we received a new complaint against Javier Tebaspresident of The LeagueAnd Jorge de la Vegaexecutive general manager of La Liga, for violation of T rulestransparency and good government.
Currently, Tebas has initiated a sanction file in the Administrative Court of Sports (TAD). The president of La Liga is about to be disqualified for a very serious infraction during the call for the first Club meeting in which the agreement with the CVC fund was approved.
In this new complaint, to which EL ESPAÑOL had exclusive access, they ask the CSD who initiates this new file and that it be submitted to the TAD so that “we can agree on the imposition of sanctions which correspond to the law”.
The complaint argues that La Liga, in its Transparency section, does not include “match minutes.” General meeting and extracts from the minutes of the meetings of the Board of Directors and of Delegated Commission“.
By failing to fulfil his duty as president of La Liga, Tebas commits a “flagrant violation of the legal mandate” as regulated “in article 27 of the Social Statutes of La Liga.”
Similarly, the Sports law of 2022, which, through article 61.4, specifies that this responsibility “falls directly on the person who holds the executive direction of the Spanish sports federation or on the person who exercises similar functions in the professional league.”
This is why the complaint filed with the CSD also includes Jorge de la Vega as executive general director of La Liga, in addition to Tebas himself as president. If this new complaint is brought before the TAD, Tebas could have serious problems remaining at the helm of La Liga.
The violation presented, which seems obvious, would be added to the possible sanction, if any, of the current file initiated for very serious misconduct. It the real Madrid denounced Tebas for discrimination in the Assembly which discussed the pact with CVC.
The TAD based its indications on the possible “very serious” violation of Tebas on the judgment of 19 October 2023 of the Court of First Instance No. 63 of Madrid, by which the request for protection of fundamental rights filed by the FC Barcelona and Real Madrid against La Liga.
Forced to increase the TAD
Currently, the case is in the investigation phase pending the proposed sanction and could result in the disqualification of Tebas. The CSD is obliged to file all well-founded complaints that reach it with the TAD, since it was Tebas himself who succeeded in doing so by filing a lawsuit when he was at war with Luis Rubiales.
But this measure can now backfire on them. In addition to the open file and this complaint for non-compliance with the rules of transparency and good governance, the CSD has, among others, the one presented by EL ESPAÑOL waiting to be elevated to the rank of TAD.
At the end of 2023, this newspaper asked the CSD to urge the TAD to initiate disciplinary proceedings against the LaLiga president for abuse of authority and failure to comply with regulatory provisions, among other reported facts.
These offences were committed by the president of La Liga after the publication by EL ESPAÑOL of the information: “They handed over to a court of USA data on alleged payments from Qatar’22 to Tebas, Villar And Sanchez Arminio“.
Javier Tebas “used LaLiga’s human and economic resources and its private funds to make an ‘official’ statement for his own benefit”, since the information published by EL ESPAÑOL referred to activities prior to his taking office as president of LaLiga.
In addition, this newspaper denounced the public statements of Javier Tebas against EL ESPAÑOL because “they violate the dignity and sporting decorum that a leader must keep in mind” and, in addition, “they violate the regulations of the very institution to which he is subject. “the president of La Liga”.
