The perpetrator of the incident, Vugar, was charged under article 127.2.2 of the Criminal Code (intentionally inflicting minor and serious harm to the health of a clearly defenseless person, with particular cruelty to the perpetrator, including inflicting serious suffering on the victim or by request).

Vugar, who testified as a defendant in the criminal case, pleaded not guilty to the charges that were announced to him. In his statement he stated that he lives with his family in the village of Aghstafa district: “The victim, Mammad, is my former father-in-law. We had a normal relationship with him and I always respected him as an adult. On the day of the incident, around 4 or 5 o’clock in the afternoon, the Hyundai car I was driving was carrying my sister Bahar, my ex-wife Gülsüm and our neighbor Gülsüm home from school, and when I got home, I saw My wife’s mother and my aunt came towards us From afar, they knocked down my sister and our neighbor Jamil came towards me and hit me, but I grabbed him by the neck and pushed him back.

According to Gülsüm, who testified as a witness in the case, she married Vugar on March 22, 2020 and moved to the village of Agstafa district: “I, Vugar, my sister-in-law and her children lived in the house during our joint marriage. on November 18, 2021. We had a child. At first, Vugar didn’t let my mother and father come to our house. After that, Vugar started hitting me and abusing my phone.

Kulsum noted that on January 18, 2023, at 7 a.m., Vugar beat her while taking her to school in a Hyundai car: “He said that I brought witchcraft into the house as a reason for the beating. He repeatedly hit me on the head and arm in the car. I yelled and told him to open the car door, he didn’t stop the car. When I came back, I told my father that our relationship was over and we took him home from school. the children from the garden, and they didn’t come in. The conversation happened on the way to my mother, I fell with the girl in my arms, she told me why I hit her. Later, when my father came running, he. rumor grew. They started hitting each other. Then the neighbors found out about the noise. I saw that Vugar’s nephew was holding my father, and Vugar was kicking and hitting my father from the right and left side. Then I took my son and ran towards him. car so they wouldn’t take him. We took my father and returned home. That day my father began to have pain. We called the police and informed them. Then we took my father to the hospital. “When we did an x-ray, we discovered that his 13th rib was broken.”

This criminal case was heard in the Agstafa District Court. According to the court’s verdict, Vugar’s act complies with article 127.1 of the Criminal Code (it is not dangerous to the life of the victim and does not cause the consequences provided for in article 126 of this Code, but causes long-term deterioration of health or a Significant loss of less than one third of total work capacity. Dissatisfied with the sentence, the defendant’s lawyer filed an appeal. The defender requested that Vugar be punished with a non-custodial sentence.

The prosecutor also filed an appeal against the sentence. The prosecutor requested that the accused be found guilty under article 127.2.2 of the Penal Code, and that a new sentence be imposed, imposing a custodial sentence.

Both complaints were sent to the Ganja Court of Appeal for investigation. The panel of judges, who examined the evidence of the appeal and protest, finally announced the decision. According to the decision, the complaint filed by the defendant’s defense attorney was not satisfied.

The Public Ministry’s appeal was granted. The sentence of the court of first instance was annulled and a new indictment sentence was issued. According to the verdict, Vugar was sentenced to 1 year, 11 months and 28 days in prison.
