The duty judge Mislata (Valencia)responsible for the First Instance and Investigation 4, accepted this Friday afternoon, in accordance with the criteria of the Public Prosecutor’s Office, the provisional release without precautionary measures of the teacher detained after having been denounced for an offense of alleged sexual assault out of seven students whose ages are around 4 years old.
The investigator made this decision after finding in the emergency investigation procedures carried out before and after his arrest “no indication of criminality founded against him”, as confirmed by the Superior Court of Justice of the Valencian Community (TSJCV).
In adopting this decision, the judge took into account the result of the urgent examination of three of the children carried out by specialists of the Institute of Legal Medicine of Valencia.
From this exploration it does not emerge”no signs of crime“There is also no evidence of any situation linked to abuse or any of the facts investigated reported by the parents, “consisting of touching, kissing and intimate photographs”.
The judge also analyzed the manifestations of the professional and family environment of the detainee and the first results of the searches at his home and the examination of his electronic devices and his cell phone, which revealed no incriminating evidence against him at this moment of the procedure.
The instructor decreed freedom and decided to refer the proceedings to the Dean of the Mislata Courts of First Instance and Investigation so that they can be distributed and assigned to one of its judicial bodies because they concern events to date indeterminate.
